Hi Bannen, thank you for the kind reply. It's not that I don't believe the good folks here, but I just think we have a lot of gray area. My issues tend to arise from claims of people stating, "you will face thousands in legal fees, prosecution, jail, delete the name now and hide," etc .... I think we all know that isn't true, lol. Perhaps if those outlandish claims weren't used, then I would consider other advice. It's hard for me to take advice when people start yelling prosecution and things that are not true, and then it taints the entire image of what I should believe.
Quite honestly, if it make everyone feels better, if Apple wanted to come after me for TM issues, they could and would probably prevail. They could also do it to the 200 Ipod domains currently up for sale on Sedo i.e. Idpods.net and Ipod.org. The bottom line is, is that they wont come after me, nor them. They could, but never would. They only do it if the name is an exact match on their company or a new product they want to sell, which is fair. And that's what people are missing. People purchase Iphone domains, MSFT domains, etc.... and although they border TM infringements, unless it's the .com for the exact match, they leave it alone. I'm yet to hear of them getting in trouble for having a "similar" domain. Further, companies like MSFT and Apple probably don't mind it as people are simply marketing their product! It's good for business you might say, which is why they don't pursue them, UNLESS it's a domain they specifically NEED. I don't foresee Apple ever having the desire to acquire nor promote the name 1ipod at this time, nor in the near future.
So again, if it is a borderline TM infringement, and I agree it is, will they come after me? Hell no! Will they go after the 200 names on Sedo? Of course not. If they chase down every domain name with Ipod in it, that would be insane. So the bottom line is, TM violation or not, Apple has better things to do, and not a chance of them wanting my worthless domain or the others. Wouldn't you agree? So I'm not worried whatsoever ever about an Icann dispute being filed. Now, when people start saying, "10k in legals fees.... prosecution .... going to jail," etc.... and you know it's BS, what would you think and how would you respond? Maybe newbies aren't fighting the the TM issues people are talking abut, but fighting the people making the issues and crazy intimidation tactics. A good way to respond to a newbie with a possible TM issue, would be to say, "It could be a TM violation, but chances are, they won't dispute it with Icann and take the name from you, but always keep that in mind that they could". And leave it at that and give the damn appraisal, lol. I can see this group chasing newbies away pretty fast, but I'm not like the others.
Anyway, I'm a good domain name grabber, but terrible with appraisals, which is why I asked for assistance.
Perhaps I can rephrase my appraisal question another way. If Apple specifically said I'm okay to sell the name, and we're good to go, what would be the price i should ask?
