Today, I received a message from Facebook legal department, regarding a domain name that I own which is like : ***ofacebook.com

They said : domain name may be infringing on a trademark for Facebook, and i should respond early for importance.
--

I believe that the domain name is *** of acebook ( acebook is not a trademark ) i replied with this part included, and I asked if they would want to buy it.

Any thoughts?

The views expressed on this page by users and staff are their own, not those of NamePros.
As a beginner, I can say (not to offend anyone),
1.) You know nothing or just a bit about trademark laws. So, please go and learn few more things by yourself
2.) Always be respectful to people who give you advice without any monetary benefits (if you don't believe me just contact any lawyer)

#Note: I am not adding any links.

I think you should counter sue them and demand they hand over Facebook.com

Look, just do what you want.

People have told you the best course of action, but you don't want to hear it.

We're not your parents. If you want to do something stupid, go wild.

Many comments here are really useless, people .. you should read this instead of talking without any knowledge :

https://www.namecheap.com/blog/help-a-lawyer-threatened-me-about-my-domain-name/

Go and check this...https://www.autoevolution.com/news/...ng-dmw-name-over-copyright-issues-142270.html

and don't worry when "Domain Name Wire (DNW)" will establish their business in automotive manufacturing them one day, they will also receive the mail (maybe). No one is going to tell this but only TIME.

also check this...https://www.dmwevehicles.com/

Good luck with your case.

In this instance, dropping the domain would be a better course of action than keeping it. I think that's the sentiment of the majority of the responses here. The argument that it is "...of acebook" will likely fail. Good luck.

Just try to sell to them (as you prefer so), if they refuse that, then give them for free to be on the safe side.

Try and sell a domain to the company that has contacted them via their legal department about a potential TM infringement?

Terrible advice and exactly what the OP has said they have done.....

The OP will not listen to the advice given, they know best on how to proceed so let them dig their own hole and lie in it....

I have no time for arrogant, know it all's who bring the industry into disrepute.....

I think everyone told you what to do

delete the domain or you lose more than that
it's a serious legal problem

People like you are why domain investors have such a bad reputation, it's not even accidental/unknowingly infringement, you are clearly leeching off Facebook's brand in hope that they pay you.

No advice from me, I hope Facebook sue you and you deserve to be sued.

@Sheries11 its depend on which country you reside in. USA, the trouble not worth but other country you just hold your line and don't give it in since it doesn't have Facebook in it, you have good chance but in USA cost of defensing in court outweigh the benefit

He shared a link from Namecheap where it clearly states

  1. DON’T write back offering to sell the domain name. This can be used as evidence that you registered the domain name in bad faith in order to sell it to the trademark holder.

And then later in thread agrees with someone who also has no clue what their talking about and says he will try and sell it to them......

🤔

if you have lot of happiness in your life and actively looking for bad days then you can keep the domain. I am sure Facebook will fulfill it.

Else, I suggest you to delete the domain.

@Sheries11

I for one am sorry to see you go, please reconsider.
A lot of posts here sound like sarcasm but a lot of us are using your post as an example to future members in similar situations.

I don't think everything is directed to you in a personal way as to get you to quit. If it seems like it please let me be the first one to apologize to you. We truly do mean the best for some of the newer members and we are just trying to make sure that you understand there is no "but" here. There is only one viable conclusion, delete the domain or give it to them.

As long as you post with anything else members will try to educate you to the error of your ways.

That said, maybe you feel strongly and want to pursue this, that is also your right.

In the end I personally would prefer to see you continue and I will ask my fellow members to maybe consider guiding you in a more gentle manner.

Regardless of your decision I wish you luck with your future endeavours. (y)

Would they prefer to pay 5000 : 10000 of dollars suing me? while I'm fine selling it for a $1000 ?

It is not worth the risk! if this turns to a serious case in court then you may be fined way more than that! I remember reading a story about someone that was fined something like $100k for TM infringement and cyber squatting!

This is seriously terrible advice.

I understand but each case is different and has its own merits. example include apple fined for using brand Apple in brazil(which owned by some other local phone company
Nissan owned by Individual and won the case
Their are many cases, were UDRP went against complaints even though they own exact name in their country extension, example Abdul basit won a UDRP for kitchen Design domain.

About this case the word "Ace" in AceBook is is a English word and different from "Face" not some typo, its a popular word.

bold cold fold gold hold mold sold can you say that, someone with domain word OLD is typo of SOLD COLD etc
