Hi,

I have an enduser interested in one of my domains , it's "big us city+autorepair.com" , I contacted him quoting a price of $600 and saying that i'm also contacting other parties. He replied counter offering $450 but mentioned , "know that I have the trademark so good luck selling it to someone else."

I searched up the trademark data base and couldn't find any trademark. Is he just joking around so that I may just sell to him?

Good luck with the sale. I personally would of taken more of a compliment his business and success approach while getting a few laughs rather then dwelling over a tm issue. Point out the relevance to his company with the domain rather then any negatives.

if your buyer talk about TM issue there's posibility that he/she desperately want that domain! to be honest I am curious with the domain name!

Worth so much more now price has gone uppity up up. Trade marks cost so much more than domains and if you own the domain before the trade mark it is actually insulting that your intellectual property becomes trademarked. I would be at $2600 now. lol

I would cancel for all negotiations, and request $1200 for this name. Being a auto repair business they should have no problem with $5k for this name.

his personality isn't a snake , he seems like a nice guy actually. He thanked me for contacting him again and said he'll discuss with his business partner regarding this.

He's a time waster -- forget about it and sell elsewhere.

Best,
Paul

You will get back a "My business partner doesn't want to do the deal" OR "My business partner only wants to pay $200"

Good Luck

do not message him bro. Just move on. if you message him, he will beat the price down. Get on with searching for the next name to sell.

If he comes back asking to lower the price, do not contact him (like a fellow domainer said above).

Instead, if he sends you email again after that, increase your price to upto low four figures with bold and caps "NOT NEGOTIABLE".

Happy selling.

The increase the price thingy doesn't work very well with endusers you are begging to buy (seller initiated the contact, seller trying to hurry up sale with frequent emails) We have an indifferent enduser here that will walk away with a standoffish price increase.

People need to be careful with the way they dish out advise, especially one that could make one lost a sale. IMO, it is best he does not bother sending another email.

Well, if he wants to go in court he is going to pay more than $600. So Since he his the only buyer for the name the seller may stick to $600 or increase the price to win over the idiot buyer.

However, if the seller needs money it is a good thing to sell it at $450 as it is really close to his asking price.

BTW it's $1,500+ for a udrp and way more in lawyer fees.

$1.5K for a single panelist ;) For 3 panelists the complainant will need to pay $4K in UDRP fees if he requested the 3 panelists (ignoring lawyer fees). In case that a three member panel is requested by the respondent, the fee is split equally between the complainant and the respondent (so $2K each).

If he replies with a low ball. Show how much spend is required keeping the trademark without the domain over time as your willing to wait it out renewing each year with your cheaper renewal.

I have one who wanted to offer $200 but when I accepted, he stopped responding. So I tried calling but he didn't pick. I had to call his office number and I was told that he was on vacation. I however got an sms from him minutes after getting of the phone with his secretary in which he stated that he was on vacation and would pick the domain name when he is back if it was still available. He seem to be on a very long vacation because he still hasn't contacted me since over a month now lol.

It doesn't matter what business you are in -- 9 out of 10 buyers are complete time wasters. Domaining is no different.

Sell on a first past the post. When the money is in your bank account then the deal is done. Until then forget it.

The -- I'll speak to my partner -- I'll pay you tomorrow -- I'm in hospital but will pay when come out -- The goldfish is ill so I'll pay when I get back from the vet etc etc never ends in a sale.

Money in bank = sale.

I'm bored.

Best.
Paul

PS good luck to the OP anyway. Hope it goes well.
