If not, he is clearly asking for trouble..and he's had it since '97???

Ugh...
This has been explained again and again and again and again....

Imagine you see someone walking down the street smoking weed. You say to yourself "Hey, I thought that was illegal, but there's a guy doing it, right there, out in the open!"

What does this one instance of someone violating a rule mean to the overall legality of marijuana?
Nothing. Just because there are people who own infringing names doesn't mean that those names aren't infringing (blatantly so, in this case). It just means that they are getting away with it.

This domain is precisely the sort of name that total newbies register, because they don't understand that a lot of the brand names they speak of on a daily basis constitute a form of intellectual property and you cannot just go register domain names that infringe on the rights of trademark owners. They don't understand that you run a risk by registering names that incorporate trademarked brands and to justify their actions when called down about them, they point to other people 'who are doing it too.'

So, new guy, take this as a lesson. You really should not register names like this. Yes, you might get away with it, but somewhere at Markmonitor, an alarm is going off and the people who are in charge of keeping track of the Chevrolet brand know of you this names existence.

The name chevytrucks.org alone is not bad faith.

(i) circumstances indicating that you have registered or you have acquired the domain name primarily for the purpose of selling, renting, or otherwise transferring the domain name registration to the complainant who is the owner of the trademark or service mark or to a competitor of that complainant, for valuable consideration in excess of your documented out-of-pocket costs directly related to the domain name; or

(ii) you have registered the domain name in order to prevent the owner of the trademark or service mark from reflecting the mark in a corresponding domain name, provided that you have engaged in a pattern of such conduct; or

(iii) you have registered the domain name primarily for the purpose of disrupting the business of a competitor; or

(iv) by using the domain name, you have intentionally attempted to attract, for commercial gain, Internet users to your web site or other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsorship, affiliation, or endorsement of your web site or location or of a product or service on your web site or location.


ChevyTrucks.org does not meet any of these as far as I can tell. It's a site that is a resource for ChevyTrucks including selling of Chevy trucks and Chevy truck parts. It's fair use. How else would one identify that you are a resource for ChevyTrucks without using ChevyTrucks as a description? That plus this doesn't prevent the trademark holder or disrupt their business... ergo.. it's probably ok.

I'm not sure that Chevy couldn't take the domain but the negative press/ impact from revoking what appears to be a legitimate site based out of a legitimate interest in their products would make it non worthwhile.

Not ALL uses of a TM within a domain ARE Cybersquatting or bad faith.

Unfortunately...... the intention of this .info likely is bad faith if it's just a revenue parked/for profit buy. The two domains are TOTALLY different
