Not sure any INDRP (the desi form of UDRP for .in & .co.in domains) was filed by the government, but The National Internet Exchange of India (NIXI), the custodian of .in domains, has asked for cancellation f a domain registered before the government started a project with similar name.

What are your thoughts?
For me it is ridiculous as the government has .gov.in and several others reserved for themselves and if its late on thinking something late does not allow them the right to take away someone;s identity established before.

Sounds wrong based on the info presented. Gov'ts always have the upperhand.
A reason to not feel confident in buying any .IN extensions, as they are open for confiscation on a whim.

the government has .gov.in what more do they need, they can add any subdomain they want. The entrepreneur has already put up a disclaimer and that should suffice. He had it for two years ahead of the government and it shows the government did not do research before naming the program.

I wish the owner of the domain luck and a skillful defense.

An weird example cannot be the reason to lose confidence in any cctld. This could have happened with any other too. Even if NIXI asks for an arbitrary decision, the court is there for a trial.

I like the CcTld's. However, each of them apply their own laws and some gov'ts make up their own rules as they go along. I see less uniformity in them than the traditional TLD's. Buying something at reg fee isn't the issue, its if you pay a lot more or develop a business on it like the subject of your post did. Risky. Thanks for posting the article.

.ca's in Canada are highly protected. You must be a resident citizen and you must not infringe in trademarks. I have owned business domains since inception and have never had a problem. Our are run by a separate non profit organization and other than the initial reserved names like Canada and provincial/city names the rest of the registry was fair game.

Canada used to be .gov.ca but now it is just Canada.ca and they would use StartUp.Canada.ca for what they wanted. They would not much care about StartUp.ca

India needs to follow that example

Could be an interesting case to follow. It really depends on how the domain name was being used, and if it started to establish a brand. India has a first to use policy, but it really would depend on how the domain is being used: functioning business product/service/brand or parking for profit.

Much more needs to be understood, but based on the very basic info provided on this post, I have to say screw the Indian government! Unimaginative morons.

EDIT: Read the article. He needs to lawyer up and fight this, assuming they have a fair judicial system. He'll win based on the current Indian laws. The problem is that corruption is a problem in that part of the world. I wish him good luck.
