Hi,

A couple of month ago I used a submission service free for one month, given as an extra for a domain registration.
Clearly it stated in their terms and conditions that you can cancel anytime within the free month, but afterwards would be charged a monthly fee of $19.99.

I used the service once, realized there had to be some changes to be made to my site, cancelled the service within the free month and thought that´s it.

As I was away for some time I never really looked into the account again. Then I was charged on my credit card, but I never even thought of this service as I did cancel.
Next month I got charged again, contacted the credit card company and requested information. I was actually charged a third time, before this was stopped.

Now I got an email from that domain registration company, forcing me to sign a detached fax which allows them to charge the three month service or I will have to pay bank fees involved, will be added to the negative "non payer" database and debt collection fees and will loose the domain name registered with them ( not a big loss ...that would be ).

Anyhow, I contacted them, stating I had cancelled within the free month, but they insist I did not.

All they want now is me to pay the $59.97 for three month, nothing extra and just to finish this grief I consider to do so as I have no proof, but then again they only claim their records show no cancellation.

I have never had any problems with cc bills and honestly am not aware of the consequences either for the company who got an RFI nor me if I consider not to pay ( we are in Germany, they are in Australia...going to court for $59.97 ??? )

Would you mind giving me your opinions, please?

If you cancelled the service within the free month then you may be justified to do a chargeback on those transactions with your credit card company. Have you considered that?

In fact the money was already charged back.
That is why they want me to pay for it now again.

You say you have no proof that you cancelled?

What method did you use to cancel? You don't have a saved email, a confirmation number or anything?

That could be a problem if you didn't cancel using the method they required in the terms of this service.

Oh I see that. Then it seems like the company would have very little recourse against you. Like you said, its unlikely they would take you to court or send international collections agents after you over $60.

Its possible they could flag your credit card number as fraudulent orderer which could make it difficult for you to use that same credit card with vendors that use the same credit card processor.

Transfer the domain to a new registar, report the card lost to get a new one, tell them to goto hell. :)

OK,

Here we go. Due to that fact that I had no access to my account with iregistrations and did not want any probs coming up I agreed to pay for the three months.
I specifically requested about tha May bill and any further and got told that all I need to pay were the stated fees on the form.
I agreed tp pay $59.97 .

As I was not online for some time I did not realize that I still have no access to my account with them.
Tried to move the name away, but it´s on registrar lock...

Today I get another fax requesting payment for May.
This is impudent and I told them I will not pay for it.

What do you think???

They will not get anything from me anymore, but, that will not get me my domain name back.

YOU CAN DO SOMETHING!

There are tons and tons of scam sites online!

Report this to them. They will publish! Make sure a whole bunch of Google results for the service points to scam warning pages basically. The bad publicity may even force them to forgive your payment.

To be ethical, i think you have to pay their fees.

You have stated that, you dint loginto your account or never used their service. That does not imply that you should not pay their fees.

They clearly stated that you can use their service for free for the first month and can cancel within the first month if you are not satisfied. I think you have not cancelled, (or have you?).

From a legal perspective the onus will be on both parties to show that they were the ones to show good faith. If they have a failsafe e-system where cancellations can only be done on line then you may have a problem. If however, they accept multiple forms of cancellation including that of telephone then the burden will fall on their door and if you maintain that you did for instance telephone them to cancel a court will accept your story. This is especially so if you have further communique that asked them to stop billing you.

My guess is from what you have said you will have a certain amount of communication with them so you have a more than reasonable chance of winning any legal battle.

My other guess is is that they will not contest and will release your name, refund you the money and go there scandalous way

If you read my first post you will see that I indeed cancel the service within the firts month.
Only that they insist I had never done so.
I have agreed to pay $59.97 to stop all this ( so much to the ethical point ) and was told I will not have to pay anything else, but was refused access to my account and domain name.
Instead they kept on charging me, still without access to my account.
We have kept copies of the correspondence with them to be on the safe site if they intend to force this any further.
