I know one more name that I saw dropped few days ago that originally belonged to one of the entertainment studios.

I haven't registered it because of trademark issue.It is still available.And now waltdisney.tv is on sale.

i got my first trademarked letter a few weeks back by a large corp..i am just very thankful it wasnt for damages

whoever gets waltdisney.tv, going be costly outcome for years to come and i am talking about the buyer...

not worth it

Exactly. Not worth picking up any names that will cause TM issues down the track.

I wonder if the names that are made premiums by the registry will give them potential TM issues down the track from trying to profit from a registered TM.

Thats a HUGE issue that enom never gave an answer about.
They are selling huge tm domains on premium pricing, so lets say i buy one of them and then i ll get a tm letter and loose the domain then i ll take my turn and go after enom.

The answer they are not giving you for obvious reason is YES, they are treading in dangerous TM territory!

Yeah, any knowledgable person will stay away from that one.. TM issues, tho I think a .info could more reasonably get away with it posting biographical info for example.

That is a really good questions actually. How can the registrar make a TM name a premium and another TM not a Premium etc... is this not Cybersquatting by definition..??? Thoughts..??

...but if that info sites decides to start making a PROFIT from that site (such as having adsense) they are now profiting off another companies name and back into dangerous territory. We were speaking about this on the "comapnysucks.com" thread. Its free speech until you add a revenue stream.

Because statute specifically exempts registrars.

I actually think it is abit of a scam... really.. to have consistency.. registrars should have to play by the same rules.. but this goes into the whole premium pricing etc etc thing.. so I wont go there... but it is quite shady if you think about it...

The thing is there would be NO registrars or registries if it werent for the blanket exemption. If not they would be held liable in every domain/tm action that came before court.

Perhaps there should be a distinction made between domains that are part of their role as registrar and names held for their own acct and benefit.

But keep in mind one other thing. No name is automatically a TM violation. Even WaltDisney.com could reasonably have a perfectly valid non-infringing use. Lots of 'em! Maybe some else in the world is named "walt disney"? Maybe someone would like to put up a site documenting or lampooning the life of the great man. maybe someone would like to sell Waltdisney laundry soap in tazikistan. Who knows? If the domain industry had to excerise prior restraint in every case where their might possibly be a tm issue then there'd be damned few domains registered today.
