Well, Apple started going after some iPod names recently, so I'm not sure how that affects value. Given .biz I'd say around mid xx right now.

its not called the new Ipod. It is called the 5th (?) Generation of Ipods. The unanymous response from the regular user is the name "Video Ipod". Search it with quotes and you get 2 million + results.

The real name was just released today- all 2 million results are about the hype leading up to it. Go to http://www.apple.com/ipod/ipod.html and look- the only reference to it is 'the new ipod.' i agree that before it came out 'videoipod' was the predicted name, and it does describe the ipod's abilities well.

You can call it whatever you like, it's still a trademark violation, therefore worthless.

As I go with TM violations. I look at the .com .net .org and the .co.uk.

If one of them still runs as independent site, then theres no use to be afraid of a TM lawsuit. Why would they sue someone with a lower level TLD?

IpodNano.com- Independent (Still UP)
VideoIpod.org- Blog
VideoIpod.net- Parking Site
VideoIpod.info/co.uk- Sedo

Apple would run at them first before me.

BTW if "The New Ipod" will never be an official name sry to say.

its either 5g ipod or Ipod.

I agree with you---I like your domain

Some people may actually consider the fact that trademark violation is an ethics issue.

Those sites you listed have all been registered for a month or less.

Go ahead and wait for someone to stop by and tell you you domain is worth $X,XXX,XXX if that will make you feel better.

Oh please dont give me your ethics bullsh*t when you sold DisneyCruise.biz, still selling Eminemforums.com, and own Idolpredictions.com (its quite obvious where your getting your traffic).

Dont even try and deny it. One thing I hate most are hypocrites. Blah blah blah.

Of course this is a TM violation. Do you really think I dont know that?

By the Way:

Do your own research right. Unless you are blind.

Try not to look to stupid, although it's probably too late.

I have no idea what you are talking about with disneycruise.biz or idolpredictions.com so pull your head out of your ass. You are either just misinformed or you are flat out lying to try and discredit me.

As far as EminemForums.com goes can you point out the Trademark registration for me. If not then just face the fact that you choose to disregard ethics while others may not.

I love how people ask for domain evaluations here and when they get the bad news that the domain is worthless they cry and stomp their feet claiming everyone is wrong.

Get over it.

Nevermind, those were a member named Iravan's thread... thought it was yours.

By the way. I will bet you money I will sell this domain for $XXX. I am not crying about a damn appraisal. I am complaining how omg a TM infraction = $0 when you dont even go look up other TLDs.

You are acting stupid.

Omfg EminemForums.com WHERE IS THE TM USAGE? I am guessing GoogleForums.com is Not Tmed either?

Wow.

Not trying to get in the middle of this but a name doesn't have to be trademarked to be protected by common law or trademark law.. in the case of EminemForums, we have a celebrity name of value, therefore it's "protected" from commercial exploitation by common law.

In any case, Ipod is a protected name... obviously these sorts of domains have value to those who might speculate in them but they always run the risk of forfeiture under the law.

What does googleforums.com have to do with anything?

If you are going to talk about my domains then talk about MY domains.

Are you going to show me a trademark for Eminem or are you just going to blow hot air?

Justify your trademark violations all you like, I personally don't give a s**t.
If you sell the domain more power to you. Sleep well. But get your damn facts straight before you start spouting off about what domains I have for sale.

In all fairness.. it's not legal to trademark a name.

Yes not to TM a name BUT:

Not trying to get in the middle of this but a name doesn't have to be trademarked to be protected by common law or trademark law

Aka how could eminem win back eminem.com if a cybersquatter sqautted his domain?

Guys, there are risks involved in TM territory but it's not a clear issue either way. There are a lot of names out there theoretically violating TMs, so it's really a matter of how you use the domain and the behavior of the TM holder (whether it's formal, or common law.) Sam, I hope you do well with the name, just make sure the buyer is aware of potential issues, and you will be fine. Will Apple go after this domain? Most likely not, but I'm not one to make exact probalistic judgements -- certainly the risk is in the lower range, but it's there some risk given Apple's recent protection of their iPod TM.
