saw this over at sedo, recent case involving Toyota and Lexus domain names.

1. The product is readily identifiable without the use of the mark;
2. The use of the mark is excessive or goes beyond what is otherwise necessary; and
3. The use misleadingly suggests that the domain is sponsored or endorsed by the trademark owner.
