OK, the deal is finally struck...

How much do you think these are worth sold together? I know there may be TM issues but these are two common words, after all. Maybe it's really "TonightsHow.com":hehe:

NBC owns the trademark "The Tonight Show" and they have disclaimed the word show (whatever that means).

Anyway, gimme some!

There may be TM issues, but the TM would probably include the word "The" IMO, per copyright. And maybe even "With David Jay Leno." Or "Johnny Carson."

I think this definitely rocks. As an info type site, developed, you could score low $xxxx. Seriously, I'd develop it, drop on Adsense, and hope for 10% of the 31k Overture type-ins (sans extension, for now) to drop you a few quarters a day.

The "no hyphen one" mid $x,xxx - low $xx,xxx without dev easy, maybe more. That will be a popular show for a long time to come. The hypen will always drag a domain down though, but not too far (1/4 of the other one).

There is certainly a trademark issue IF you used the domain name in anyway that attempted to profit from the NBC show. You would be automatically subject to treble damages, plus attorney fees since NBC has trademarked the name. "The" doesn't make any difference. Disclaiming the word "show" means they aren't claming they own the rights to the word "show".

You could probably use the domain name for anything that wasn't related to entertainment or television. For instance, if you started a company called "Tonights How" selling software that wasn't related to entertainment or anyone associated with the show on TV, you would probably be alright. If you got traffic to your software company because people typed in the name looking for the TV show, that's ok - as long as you didn't do anything to make them think it was the TonightShow (like using the keyword word Leno anywhere on the site, etc).

A company that owns a trademark is REQUIRED to take action against anyone attempting to use capitalize on their trademark. If they don't take action to protect it, they can lose it. That is why you see these huge companies going after small time operations for trademark infringement. They aren't worried about some 12 year old kid using their name to sell lemonade, they are worried about losing their trademark because they allowed someone to openly infringe upon it.

The domain name certainly has some value, but it's hard to put a number on it because of the TM limitation.
