I just registered this name 2 weeks ago.

Starwars.ws <-- yeah I couldn't believe no one had it!

Is that some trade mark illegal thing?

Develop it and see what happens, I wouldnt think they would take it off you, I mean without fans, talking etc... they have nothing.

well, see.. Lucas is extremely anal over his stuff.

a while back I did some charity stuff for a group called the 501st (for sick kids mostly), and in that we used SW's outfits. The only reason we were able to grab stuff like storm troopers, darth vader..etc.. was because lucas licensed us to use the original molds to cast our own (since it was not for profit, done to entertain sick kids.. once in a while he would have us do his own promo stuff i guess as payment to him for the agreement)... but no where else will you find these outfits. Lucas shuts them all down.

so for the name itself? I would say that you should tread very lightly

I think if you were to start a site supposedly about movie/music stars etc......that were divorcing or fighting with a studio/record producer I don't think you would have any problems...
There is also the StarWars space/defense program.. For example

Start selling StarWars Lucas gear & I think you may want to wear asbestos underwear...

The real scoop on this so called "TM" names is - if you can get them buy them.

They are great traffic names and no big brother is coming after you as many seem to mislead on this forum.

There are many uses for "TM" names, and there are many out there wanting to buy them.

And let me ask you a question. How do you know who is going or not going after you? IS this something you are assuming? Or is it just because you have been lucky and not had any incidents yet? Why is it misleading to tell someone use of a trademarked name is not a good idea?

Sure there are many uses for TM names. Does that make them legal uses?
Your wise words make me want to grab every microsoft, google, yahoo, starwars, and any other trademarked name I can get my hands on because you say its ok . Maybe next you can tell us how many uses there are for using the TM names with bootleg copies of microsoft products or google /yahoo names with generic half ass search engines.

it would be foolish to purchase a TM'd domain name and not think you could get sued. thats not domain experience telling you that it would be ok, it is lack of experience.

it is advised you seek advice from professionals before (if you do so at all) before you buy something like that. the risks far outweigh any chance of potential.

How do I know if the name is a registered TM name or not?
And does the TM only applied to a specific area or worldwide????

First off you where not attacked. They were questions and judging by your response it seems you cant answer them. the Name was STARWARS.WS. Not some variation like starwarsnews.ws or aboutstarwars.ws he asked if there was potential for trouble and it seems everyone but you agree there is. If he were to put anything to make a profit from that TM name it could cause trouble.

This is the US patent and trademark office. I am not sure about the worldwide use and I wont even say I do . There are several words that have multiple trademarks so I cant anwser that either.

My suggestion and opinion to anyone asking about TM legality of domains is to do your own research. In many cases, emailing the company itself and or the "owner" of the name will clarify many issues. I have done this on a handful of ocassions.

Nothing is black and white when it comes to this.

I am certainly not an expert, but always willing to share my opinion. I have been doing this now since 1994 when I founded and started my own ISP and later sold it to a much bigger "entity". Again no expert, just someone that has been around and walked the talk.

German Supreme Court Validates "First Come, First Served" Domain Registration System

Despite claims of trademark infringement, the right to register, buy and sell generic or descriptive domain names was reinforced this Spring by the German Supreme Court in a case involving WELTONLINE.de and the German newspaper Die Welt (welt meaning 'world' in English). In dismissing its trademark complaint, the court ruled that registration of a generic domain name is not per se infringing. The court made it clear that the first come, first served system for domain registration used by the .de registrar DENIC was a fair and legal method for assigning rights to a domain name. While the decision did not rule out that generic domains may potentially infringe trademark rights, the court held that the intention behind a registration is irrelevant unless the act of registration itself can be seen as infringing.
