Hello everyone,

As you may well know I was the original winner of music.mobi with an ending bid proxy of $611,000.

I was emailed by Sedo in 2 occasions confirming me as the winner and was also invoiced and given directions to pay the $66k that I originally won the auction for.

Unfortunately claiming that they could do this, Sedo said that under their TOS they can repeat the closed auction and invite new bidders who were not even involved in the original auction. Both Sedo and the MTLD both sent a bulk message to all their email list claiming that the .mobi auction was such a huge success that their servers went down. The reality of the matter was the servers were slow but did not go down. Also they engaged in an illegal behavior that voids their TOS.

I will be personally be suing SEDO USA and the MTLD and punitive damages resulting in the loss of music.mobi. I also want to sendout a class lawsuit for all you bidders who were outbid by "foreign" bidders in the second auction even though you were the original winners.

I was actively bidding on seven names during the auction - I attempted to make bids on all 7 names after I was outbid on these names; I agree timing is important in life, but would it be fair to award these bidders just because their "highest" bids got in before the servers crashed - with still 6-7 minutes to go. Surely we recognize the most intense bidding occurs in the last 5-7 minutes on these auctions; inevitably the auctions get extended by "9 minute" intervals on each higher bid at cut-off time.

Still, I empathize with those who received "winning confirmation" notices from SEDO. I realize the system is automated, but SEDO should also realize problems like this could have occurred; now of course, they have a serious problem. I hope there will be an amicable resolution, but I do not think this will be easy.

I think sending out that email to everyone that Sedo's servers had went down because of the demand really sealed the fate of this one...

I received an email letting me know that ".mobi was so popular it crashed Sedo's servers!"

Yet... I didn't even make a bid in the auction...

If they sent these to everyone who ever bought or made a bid on a .mobi name in the past (which I'm guessing is what they did), I'd say they're guilty as sin and deserve to lose this case.
