Being a resident is not the only way to qualify. An American citizen resident overseas is eligible as well. Read the policies carefully.

I think it's safe to assume the person buying will have to comply on their own. I don't worry about selling to a non-US citizen, but do let them know they need to establish nexus shortly after buying it. They can do this by filing for a taxpayer ID number with the IRS, or starting a LLC or corporate entity in the US for nominal cost. If they don't comply, they are taking the risk of losing it in a nexus disupute.

It is only fair to warn a buyer though.
