Question about selling neopets.com help sites

In neopets terms, you cannot make money with the site, if there is names, images or anything to do with neopets. Does this include you cannot sell a neopets help site? Can someone sum this all up for me.

neopets is the one that will give you the best, correct answer.

Does the site's domain name contain the 'neopets' trademark in it? Does it violate the neopets trademarks or copyrights? Are images taken from the neopets site without permission?

My gut feeling is that if it's a neopets help/fan site and it's clearly disclaimed and obvious that the site is not an official neopets site then you won't run into problems selling it. However I'm not familiar with neopets history of going after third-party neopet sites.

Well I haven't heard any stories about Neopets suing anyone personally, but as for answering your question I'm not to sure really.

Yep, I believe that as long as it doesnt contain their name in the domain then it should be fine to sell the domain.

They may still have grounds for a complaint, specially if you use neopets graphics and colors. Care to try it? :p

the reason i bring this up, is there was once a website called neogamers.com. It did not help anyone at cheat, just gave them ideas on how to play the games on neopets. They followed neopets terms and conditions completly. But then neopets turns around and sues them. the kid that owned that was only 14 years old. And neopets did win, because they changed there terms and conditions. Also, i have a domain that i use for free hosting with cpanel, well someone made a neopets help site, and i got this email:

NeoPets.com, which has millions of registered users, is a COPPA
(Children's
Online Privacy Protection Act)-compliant interactive entertainment
website
targeted primarily to children and young people ranging in age from 6
to 20
years old. On behalf of NeoPets, Inc., I hereby request that you

This site is violating your posted Terms of Service because it violates

And getting to the point, I know pretty much all of the owners of the big neopet help sites, and a couple wants to sell. I told said, isnt that against the neopets terms and service? Heres the link to there terms and conditions

I just dont want to get any legal troubles. Neopets has sued many site owners. Its never in the clear, but i have heard about it and actually seen some letters sent from neopets legal center. This email was also sent to my home address, and i got a phone call as well .

And the reason is, i want to possibly buy one.

Im scared to do anything with neopets stuff. Its crazy....

it sounds like the site that neopets requested you deleted promised some sort of cheat that gives free neopoints or something, if the site your selling just gives hints on ways to play the game and you don't steal trademarked images than you should be fine. an example: http://neoholic.com neopets is aware of this site and is fine with it if you site is like this one you'll be fine

and hey, if your selling it then it's not your problem but the person who buys :D
