Absolutely wrong about the fictitious name filing, and I would recommend seeking competent professional advice about forming an LLC beforehand.bmugford said:No, you don't have to file anything to do business under a certain name. My advice is if you want to operate as a business though, form a LLC. It is the easiest to form, and provides protection for your personal assets.

Forming a LLC is simple. It takes a couple pages of paperwork that you can file yourself. If you are not comfortable doing it yourself there are numerous companies and attorneys that will do it for under $500.
