Today has been a terrible day for me here on this site.

I will explain the whole thing. Please, I do not want a discussion on this topic or anything else. I just want to explain myself..

Recently I started a thread looking for offers on some sites... I have been very busy lately so I didn't have the time to put into the thread for an auction...

On one of the sites I put $35 or best offer..... Currently this same site has been for sale on some other sites including my own site....

At any rate, because I have been busy I have not been checking this site every minute like I do sometimes... Someone replied to the post "Sold"... When I saw this post it was just after I had gotten another offer on the site through e-mail for the same price....

I contacted the person here that made the offer and told him I had a $35 offer and I asked him for $40.... If he did this I would have told the other party involved that the site was sold....

Instead of giving me the additional $5 I was all of a sudden unethical and everything else. I have been threatened over this and insulted and my name and reputation have been dragged through the mud...... I never meant for this to happen.... All I wanted to do was sell my sites for as much as possible and someone else was willing to pay more...

I apoligize for not being clearer with my instructions.....

At this point I am supposed to tell the other party that already bought the site that they have to sell it back to me so I can give it to the person here... That is supposedly the "right thing" to do.... Or I am supposed to show proof by showing personal e-mails... I will not do either of these things...

many people here take offers even durring auctions and are not asked for proof.... This was a matter of $5 and I did everything I could do to make it right but I will not share my personal e-mails. Also, I will not buy back the site in order to resell it to the person that has caused all this trouble...

Finally I just want to again say that I am sorry for any trouble. It was not my intention and it will be a long time before I sell another site here. Despite what people have said about me, I am an ethical person and I am not out to steal or take advantage of anyone.

Please, do not respond to this post to argue or anything else... Just read it and take it for what it is... I don't feel I did anything wrong with the sale but what I did do wrong was maybe display my anger a bit too much and I should have been clearer about the sale...

next time I ever sell anything I will include something like this

"Seller retains the right to make final decision on sale"

I do love this site though and if I am thrown out of here for something so minor I will surely miss you all and all the things I have learned here. it is nice having a place to go when you have a question that needs answering... I thank you all...
And what ever you do... be careful if and when you sell a site here because there are people that will complain about everything no matter what you say...

I think most people assume that "best offer" means best offer
under $35. But, of course the best offer could be over $35

He never said "best offer under $35" or "over $35" so really it could be anything.

If kokopelli really cares THIS MUCH about something so trivial, then he should take it to court, where the "$35 rule" won't stand.

So, if you would have posted sold to the sale and then asked for more it would be OK? What if after posting sold kokopelli refused to pay?

This is NOT about $35 or some site. This is about maintaining proper business practices.

Sure, it's his domain. He can do what he wants. And if he posted sold and kokopelli refused to pay, then the domain would still be his. There's no issue here. Simply put, it's not worth this guy getting banned over I don't think (if that's what you're considering).

Are you kidding?

If you post something for sale, you well better be prepared to sale it. Both buyer and seller are obligated. If you do not believe that, I would HIGHLY suggest you stay out of the "Marketplace" forums. :imho:

As for banning someone, if they fail to follow through your dam right it will happen. It has in the past and will in the future. The marketplace is not the place for jokes and games.

I reread the whole thread and I completely agree with Kokopelli and Mark. In common selling terms, $35 or best offer means that you can take it at a BIN of $35, or offer something lower. I don't know why people like you, Chulium, are arguing about this as the seller himself admitted he was being unethical. ;)

I admire Richieboy67's courage and integrity in publically admitting his mistake and I hope that everyone can try and put this behind them. Everyone makes mistakes!



P.S. For future reference, maybe there should be a stickied "Marketplace Terms and Etiquette" thread that goes over common marketplace selling tactics and vocabulary. :)

Consider this... possibly a new guy to the industry. He got confused, a little discombobulated, and made a slight error (depending on your stance to the situation). No need to call somebody an "unethical seller" because of that. That's a critical accusation that jumps to conclusions sooner than explanations can be made and remedies applied. A simple fix if you didn't want to go accusing people.

I understand completely, and I wholeheartedly believe he should just be given a warning and should not be banned.

#1 - While there may be a way to get around the "wording" of "Our" sales threads legally - Anyone in this industry that deals in the Forums considers the "wording" in Sales threads as good as any contract .... period


#2 - This was being handled in Private ... So the "open" accusations or whatever you may call them Was not the Staff's idea .... There was a "Simple Fix" offered upfront to this .... Sell it to the one who Posted "Sold" Well before it was posted in here.

There were many "Private" messages sent between many people as well that you are not able to see .... Though I can not see where they would change anyone's mind on this subject.

PS - The only "Banning" or "Closing" would really have been over "Warning Points"

It's opinion, and how are newbies - or inexperienced sellers - supposed to know that? You can't expect them to be perfect. I wasn't...

Why not just warn him? No need to ban him like a scammer...

I would "consider this", but this is simply not the case. Both are veterans to this industry. Nobody from NP staff called anyone an "unethical seller". The inappropriate actions were called to the attention of the seller and a request made to perform a "simple fix", but this was met with tremendous refusal. Not to mention accusations of "discrimination" and lawsuit.

Exactly what happened, but due to the members previous infractions:notme: his point count went over 20, thus was "banned" for two weeks.

Do a google search on Charlie Wenzel... I don't think this case is as bad as Charlies, but sellers should honor the initial offer. First time stamp is assumed to win.

If he did infact receive an offer at the same amount of $35 via email, then doesnt the old first come, first served... come into play?

Doesnt that mean the email offer gets first dibs on the site?
