For the 100th time, no, 1000th time, a word does not have to be registered to have TM issues... a word only has to have acquired a secondary commercial meaning to have potential TM issues...

I urge anyone who disagrees to do some reading on the subject before they comment. The internet is a wonderful thing and is full of "information", free for the viewing.

Just because there are 100, no, 1000, other domains with the word PSP in it, does not mean there will be no TM issues.. they may also be under the mistaken notion that it is ok to trade on a word's notoriety commercially.

Some will slip by, some may not... you buy your ticket and you take your chances.

As you may have heard the phrase, "ignorance of the law" is no defense in court.

Hmm. I'd better tell the thousands of video gaming sites that collectively gain millions of uniques daily that they should quit while they're ahead, as their domains contain the relevant console name. Same with some of the gigantic car model-specific forums. The fact is, yes maybe they could legally take the name. But this alone shouldn't make you delete it. You have to determine the likelyhood of it happening.

With a sub-standard .net like pspgaming.net, the chances are as close to zero as you can get.

I won't ever deny you might be able to develop a problematic domain and derive revenue from it.. but the more success you enjoy (which is what we strive for), the greater the likelihood all your hard work will be wasted and you may even be assessed a heavy settlement.

I point out potential TM issues, not to be a "bad guy" or "doomsayer", but to give a heads up to "potential" problems down the road..

I certainly wouldn't want to spend months developing a domain and then have it all come to ruin because a) a competitor made waves and reported the domain, or b) the trademark holder themselves happened upon the domain and decided it was time to take action.

I personally believe it should be "first come, first served" with domain registrations... but the courts consistently rule otherwise.

It's very unlikely that you will have any TM issues with PSP. The reason I say this is that PSP also equates to Photo Shop Pro, so if Sony were to be nasty about it, I think the Photo Shop folks would not mind getting a huge chunk of Sony's assests. I did some thorough checking before I regged PSPTrader(s).com and PSPforsale.com

Your logic is faulty... while it may be unlikely that he'd (or you) have a run-in, the potential still exists because of the secondary meaning attached. As I say, it does not have to be a registered trademark and the fact that others have made the same mistake is no absolute protection. I am aware of the PaintShop Pro similarities as well...

It's frustrating to comment on "potential" TM issues as a heads up, then run into the "well, everyone else is doing it, so it must be okay" argument.. ;) Lawyers love this sort of logic.

You're saying the domain is worthless because of potential TM issues, when really the potential is differentially small. I believe this business is also about risks - some of which are worth taking.

Obviously the domain is not worthless.. I'm just saying as always with TM issues that you take a risk in devloping the name, putting your time and effort, as well as money, into it and also run the risk of having it taken away.

I think it would be irresponsible to evaluate a domain and not point out potential problems is all...

Major TM issues. I would sell it while you can, and definitely wouldnt develop it. Its probably worth low-mid $xx , but I would never develop something like that.
