I have a buyer who has approached me to buy this domain, how much should I ask for it?

Trademark infrigements will arise with such a domain name, Twittery. Last time I read Twitter was not going to allow anymore usage of their trademark in domain names. (tweetery would be ok though)

Just my 2 cents!

Yeah and whats it worth?

$500 - $1499

Anything less than wipo fees.

Though I must warn you that you're playing with FIRE!

Twittery has been in commercial use for at least 3 years as the name of a Twitter app for Macs. So you could get into trademark problems from multiple sources! Then again, it's a dictionary word as well, so could be used to build a site about birds:)

I would take $500 and move on.

Less than $0

Its a TM name

Agree $0

Nothing but hassle ahead for this one. :imho:

I have to agree, as well.

$0 due to the Trademarks

For TM claims to be valid, the names actually have to be trademarked, which Twittery isn't.

That is completely false, do you really think I can go and register Microsoft1.com because that exact phrase isn't a TM????

lol @ the people telling him $500+. Needed a good laugh.

For TM claims to be valid, the names actually have to be trademarked, which Twittery isn't.

If your name has anything to do with twitter they can do whatever they like. I do see that you have obviously thought about this and not used twitter as a keyword on the parked page.

Still - I would assume that most people that find your site are looking for some variant of twitter and if they are, that in itself is a sign of bad faith.

Just sayin'

No, but you could use Macrosoft, which is already successfully registered.

Macrosoft doesn't contain the word "Microsoft" though

Titter(y) does contain their trademark?

Just have a read through here to see how TM's work, its all about showing bad faith, and this is obviously one of those cases..

Btw if you register Macrosoft you have to use it for a real purpose or Microsoft will take it from you if they want.

Regardless of any Trademark issues... if he has a buyer for the name, it is none of my concern.

If it's not bothering these guys:

http://twittercounter.com/
http://twitterfeed.com/

...then I wouldn't be worrying me either, especially if you're going to be selling the name anyway.

I wouldn't be selling this name for less than a few G's!

My 2 pence ;)

Jiblob...that's a cr@ppy attitude to have, why would you encourage someone to sell a TM name, incredible coming from someone who has been a member since 2004

That's the perfect way to show "bad faith"...by profiting from their TM

Just delete the name and take it as a lesson learnt

First of all Twittery.com was created in 2004, two years before the current Twitter.com existed or their trademark was filed. A lot of people are jumping to conclusions it seems that this name was registered after Twitter became well known, which it wasn't if you do a simple WHOIS query. Just because Twitter is a trademarked word/business doesn't automatically give them the right to take away Twittery.com unless of course the owner is in competition with them or making money off of them in some way. If the owner decided to make a bird site based on the definition of the word or any other site other than a social networking site he'll be fine, IMO.

Looking at the domains' history, I wouldn't give it a cat-in-hells chance in UDRP.

Registrar History: 3 registrars

NS History: 8 changes on 6 unique name servers over 7 years.

IP History: 37 changes on 16 unique name servers over 7 years.

Whois History: 38 records have been archived since 2007-09-02 .

Hi gilescoley,

Thanks for the feedback, it's appreciated.

I looked at the domain and as a result did some further research online about the word "Twittery", the domain Twittery.com and trademark law.

On my travels I was successful in finding out that "Twittery" is actually a genuine adjective, cited from long ago.

http://dictionary.reference.com/browse/twittery
http://www.thefreedictionary.com/twittery

Baring in mind that the word "Twittery" is a genuine adjective, as long as the name is not stepping on any other IP of Twitter Inc (Their specific trademark classifications), then that would suggest to me that the name is worth developing at least.

It's also important to note the registration date of Twittery.com and the date at which the "Twitter" trademark was awarded to Twitter Inc:

Twittery.com Registration date:
Aug 24, 2004

Twitter Trademark:
May 12, 2009

Twittery.com long predates the filing of the Trademark by Twitter Inc by some 5 years.

Hope this helps explain where I'm coming from.

Luke

Registrars - so it's been moved to 3 different registrars (not to be mistaken with registrants/owners) in the space of 4 years?

I can't imagine that any of this data means anything in the UDRP.

Luke
