You have to be careful how you use this. It is fine for a fan site, but if you try to monetize if you could have issues.

You mean a fan site? With most fan sites though, there are ads and with ads obviously comes money. I have never heard of a band suing someone because they used their name. That would be bad press. If if that site there were free music downloads that would be different. But the name alone is actually welcomed at least imo. Bands love that (at least my band would.)

Presumably you're not Ozzy Osbourne. I wouldn't touch it for anything, not even a fan site.

There are people then there are a people… Ozzy Osbouren is one of the biggest music legends around… his name will live forever…. just like this domain name will….

I my decide to develop the name, I would just like a value on the name as I know I won’t be able to do all the work myself….

I am more interested in what sort of commodity I am working with and the value of the opportunity…..

I have name parked at sedo to see what sort of parked traffic I get….

Thanks

Eric

Many stars and musicians have sued and won against people who reg there names. metallica sued and got metallica.com . and there is a country singer that is suing an individual who regged his name even thought its the same name as the singer. An Ozzy is a legend. I mean do you think if you regged the beatles or MichealJackson they wouldnt sue you . Ozzy is as much a marketed name as any. I also wouldnt touch this name at all unless its a pure fan site and makes no money. But anyways good luck.

They basically have to show 3 things to get the name.

1.) You are violating a Copyright or TM.
2.) You have no legit right to the domain.
3.) You are using the domain in bad faith.

As long as you are using the domain for something other than a strictly revenue based stream, it is hard to prove #3.

Ozzy wife, and her dad were/are music mangers, they know this legal stuff like crazy(train). I wouldnt want her after me lol. If it can only be a non money making fan site, then the appraisal is reg fee. Good luck

Here is the story I was talking about. keith Urban sued a guy who also was Keith Urban and was not even using the site in any shape or form related to the Singer. I personally think this is ridiculous and in no way do I personally think that K Urban the singer should get this persons domain name just because he is famous but thats probally how its gonna go .

http://www.dailydomainer.com/200759-keith-urban-sues-keith-urban-over-domain-name.html

ustralian country singer Keith Urban has filed a lawsuit against a US painter of the same name, claiming that the lesser known Keith Urban's website KeithUrban.com infringes trademark and cyber-squatting laws.

The Australian singer's own website is located at KeithUrban.net. He wants the other website to be shut down and its domain name transferred to his ownership. He also seeks unspecified monetary damages.

Keith Urban the painter uses his website to sell oil paintings, but the singer, who married Nicole Kidman last year and who is a former alcohol addict and cocaine abuser, says in the lawsuit that the website is being used "in a manner likely to deceive the public into believing that the website has a connection to Plaintiff that does not exist."

Yeah, well Nissan has been suing for like 14 years to try and get Nissan.com

How has that worked out? Last time I checked they lost over and over again, and the page is still owned by a guy with the last name Nissan.

Part of the dispute is they have to prove than you have No Rights to the name. If you own a domain that is your personal name, they have little to no chance to ever getting in unless you are intentionally trying to deceive.

The singer is saying "in a manner likely to deceive the public into believing that the website has a connection to Plaintiff that does not exist." because it's their only tiny hope of wining the case. It sucks having a boring "joe brown" name like Keith Urban

All I know is if Nissan can't get Nissan.com, then Keith Urban is just wasting his time with that lawsuit in the first place.

Well the site still belongs to the painter and he actually has links to the legal documents on the site . This and the nissan are bogus cases as it seems they are legit . Now the difference it the posters name is not Ozzy Osbourne . if the painter name was not Keith urban and he had keith urban the singer stuff on it OR the nissan individual wasnt named nissan and had links to nissan car stuff they possibly would have lost the suits and suffered monetary damage.

Bad Faith still needs to be shown in the dispute. However, that really limits your development options also since there is no clear definition of "Bad Faith".

Obviously if it is forwarding to a porn site or something that is "Bad Faith". But is a legit fan site with a couple ads on? That is a gray area.
