Dispute with an indian based programmer.

I posted a project on GAF and made my choise of programmer (agreed fee 1500$usd) back in late January. I made a advenced payment of 20% as agreed. We have ongoing communication (note the programmer is based in india) - the project should take 30-40 days. when the time for the alpha testing he states that the project is to complexed to be finished in the agreed timeframe - I agree to extend the time as I focus on quality and do not want to stress the programmer - when the new dedline aproaches I email him two week in advanced just to note the deadline - I receive an email stating that he has been to hospital and could not finish the programming nor contact me - after this I have barely received any answers on my emails regarding questions about deadline, progress etc.

When I treatened him that I would file a dispute with paypal and GAF - he bearely reacted.

What do you think the chance is to get back the money via paypal?
Do you have any experience yourself with these kind of disputes - and how did the end?

Looking forward to feedback.....

Unlikely youll recieve funds back from Paypal.... I had a similar incident, but fortunately I did not pay in advance... not a dollar. If the project is completed to specifications... programmer gets paid. Programmer took on a job he couldnt complete.

I think your about to learn that lesson... dont pay in advance, or atleast open up escrow and hold it in escrow until completed. My understanding is ebay does not guarantee virtual items.. (IE - Web Development)... I think its too tricky to police.

$300 isn't a horribly expensive lesson, though it stings nonetheless. Also, when dealing with "legitimate" development companies, this same sort of thing is prevalent. Companies make promises they can't keep in order to get sales all the time. There really is no sound solution other than to research a company and be willing to pay for quality.

Regardless of the fact that the goods are digital so not covered by paypal they also have a restriction in place that states a dispute can only be placed within 45 days of the transaction:-

13.3 Filing Deadlines. We will not grant any Claim unless you first initiate a Dispute in our Resolution Center within 45 Days of the date of the relevant payment and then escalate the Dispute into a Claim within 20 Days of the date you file your Dispute. It is your responsibility to keep track of the deadlines under this section.

Slim to none.

Don't hire non-us programmers. You have no recourse if they screw you.

Of course we're assuming Snoopy is american, which is the case with most people that communicate in english, specially domainers. :)
