If i'm making a website called "spears.com" for example for britney spears. Aside from getting permission from britney to make the site. Can i put mp3's up on the site for free download and not get in trouble for it? I know that is a touchy subject, some record producer told me that they are trying to regulate it but hasnt happened yet. they want you to somehow pay royalties even though you are not directly profiting off of the music. Opinions/facts, thanks

if it is copyright material, you can not upload there.

Are you talking about uploading her music to a site?

I usually get on dnquest about saying this, but, this one is easy ;)

And a "record producer" told you that it wasn't regulated yet?

Anyhow, don't do it.

Instead of asking here, you might want to try asking a lawyer, the RIAA or any of the record labels. Many of the users here will say "Sure, go ahead" without themselves fully understanding the legal implications of what you want to do. With legal matters, it is best to seek the advice of a professional before committing yourself to anything. Copyright law can be quite complex and fines can be quite high if you do the wrong thing.

that makes perfect sense, the only problem is my trademark lawyer i use charges $350 per hour!!!. He'll give me general answers, if i want a real answer he says "if you want , i can do some research and get back to you" that is the KISS OF DEATH haha

His answers will be infinitely more reliable and valuable than any you might get in a forum. While some replies in the forums may be 100% spot on, the trouble is determining which answers they are! ;)

Maybe a $350/hr TM lawyer isn't the right lawyer to ask, but you really should seek professional legal advice, especially if you intend to make money by streaming music.

Come on, I only say that with the easy ones. But most threads always turn into something more than originally started. I usually am long winded and try to make a point.

And yes, this is an easy one.....
