it puzzles me how long is NameJet using outdated and unwritten rules on its web site without getting into law suits in a (great) country where one can be sued by almost any reason.
According to their TOS and FAQ:

A public auction only takes place if a customer failed to remit payment for a previously auctioned domain name where the private auction was older than 30 days. Public auctions are open to all users except the previous winner in the private auction that failed to remit payment.

this is not true since there are private listed domains for sale that are marked as *public auctions*. they should be marked accordingly to the new rules set at TOS:

Except for special rules that may apply to certain domain names, in which case, those special rules may be posted next to the domain name(s) and will be the controlling auction rules, the following additional rules apply to each of the below types of auctions:

this is not happening on most of private sellers portfolios being listed auction in public format, which sometimes may lead to a person bidding on the domain at higher bids without noticing it (public auctions are now getting minimum bids before the auction ends that match reserve bids).
the mere fact of auctioning private seller's domains is out of the scope of the TOS and FAQ, but anyway...
what pissed me of it that recently i was put on an private auction for OSO.COM. the domain was expired from Register.com and seems to have been transferred to Enom, a move that is getting frequently because of NameJet's new rules and the managing partner Enom.
the domain was then put in a private auction without any minimum bid and I was awarded the domain as being the higher bidder. There were only 2 bidders which, given the quality of the domain, points out to an increasing issue with NameJet's listing domains from their registrar partners at Web.com that place them on auction without public notice and without a pre-bid period.
however, when i check the auction details i saw that the domain had now a minimum bid price and that the auction was canceled because of not reaching the minimum bid.
the problem is, there is no "minimum bid" private auction format that ends with the minimum bid not met. none. when you have a minimum bid that is not met, the domain will not go to auction. when it goes to auction either it's a public auction with a minimum bid and/or reserve bid or a private auction with a reserve bid. there was no reserve bid in this case. the fact that this is so is that there is even no auction status that ends with "Minimum Not Met" that shows up on the "Auctions Report" page. One cannot filter the auctions by this status. We only have:
"won", "pending payment", "non payment", "lost", "reserve not met", "cancelled", "refunded", "past due" and "admin hold".
to me it seems that someone made a mistake. but if a mistake was made why just not cancel the auction and recognize that? I have seen several premium domains being placed on private auctions without being in a pre-release period in a clear buggy move but almost all came through.they were not cancelled, and certainly not cancelled with made up rules.
has anyone come to a situation like this?
