I am not sure what do do on this issue as I know of a company that is coming up with an product release very soon that is a generic term and they DO NOT have any of the .com's regged as yet.

Not sure what to do as its NOT an issue with TM or copyright as I said its a generic term.

Any ideas how to proceed?

Hard to say without knowing the specifics ... can you run it by a qualified ™ attorney quickly in private (before potentially registering/acquiring the domain name(s))? :blink:

PS. How do you know presumably non-public information ... in advance? Discuss all aspects with counsel, IMHO.

Public knowledge is good, I'd still make a quick consult regarding the domain name(s) and potential for future dispute, etc. (for instance, a ™ can be backdated, and it might eveb be in application stage now - yet still showing that one doesn't exist as of today), IMHO. :gl:

Better safe than sorry.

By now, I'm sure you've given this a considerable amount of thought and I'm willing to bet you check the domain every day to see if it's still available.

My suggestion is to simply purchase the domain.

Develop it or simply forward it to one of your sites.

If you don't purchase it, you'll be kicking yourself later when:

1. You check to see if the domain is available and you find it registered along with all other extensions.

2. You hear through the grapevine that someone just made a LOT of money by selling the domain to the company.

Spend the $10. Buy the domain

Pick it up, if the launch is successful then you may be on to a winner.

If your conscience still bothers you at a later date you could simply give it to them and you will only be a few bucks out of pocket but your moral dilemma will be resolved.

Register the domain.. now... what are you waiting for??? If you have a great feeling about this product/company, register as many worthy extentions as you can (I'd reg the .com, net, org, info, co.uk, .de, .in, .cn for starters)

Windows is a so-called generic word also. But if you registered any domain name bearing windows and put any software-related content, it's practically infringing Microsoft's Windows trademark.

What you're considering is potentially...potentially...cybersquatting. Up to you if you're willing to play the game.

Morally you should contact the company informing them to register the related domains.

Monetarily you should register the domains asap and have them sitting on a blank page with only a "for sale" mailto link.

It's your call.

'Tis simple, they are a company, and will make much more from the product than you will for the domain :)
