Let's say a company registered name is Aldubai Travel Co and the first word is the onwers last name some thing like Hasan Aldubai but he shares the name hundreds or maybe thousands of other people some of them have their business like Aldubai Restuarant or Aldubai Jewelry.

My question is if I find out that no one has registered Aldubai.com and I register that name is that gonna be a TM issue or not since many different people share name last name. Pls advice, Thanks

Usage is really where a TM issue comes into play. Name alone means nothing. If you get that domain and then use it for a travel site you are infringing on Aldubai Travel Co. If you use it for Jewelry or Restaurant you could be infringing on the others with that name.
