You are too funny! Did you miss the part in your post that says: 'NO CLAIM IS MADE TO THE EXCLUSIVE RIGHT TO USE "LOTTO" APART FROM THE MARK AS SHOWN'. All this is is a trademark for the specific design, not for the word 'lotto'. You can't possibly be dumb enough to actually believe the first time the word 'lotto' was used in commerce was in 2013, can you?

I actually do understand TM's but more about domain/internet law, the TM is filed by Connecticut Lottery Corporation, its all about usage with domains and what your intent is with the name...any other ideas on what LastMinuteLotto.com can be used for? Cmon, anyone can see that

Oh, so you really don't understand. Being a dictionary word is not relevant alone, you took my statement out of context or did not understand it, it is the fact that the use of the word does not differ substantially from the definition of the dictionary word, which is actually, lottery. Apple as a computer manufacturer differs from the dictionary definition which is a fruit, get it now? This really is the most basic element of trademark law.
As for the case you have linked to, its quite an interesting one, as they do not own any trademark containing 'Lotto' but they do own 'Texas Lottery Commission', and considering that lotto means lottery and the domain name was lottotexas, this was enough for them to win against that use. But no one owns 'lottery' or 'lotto' they are both generic words that have been used in many countries since before trademark law began. If someone owned 'Last minute lottery' they could file a complaint and possibly win against 'Last minute lotto', but who else could?
ok, Im just showing it makes no difference about it being a dictionary word, its better to stay away from terms that are TM'd especially when using them in the same industry, simple..if he was using "LastMinuteLotto" for a last minute flight booking company, then thats fine, he will be ok as its not infringing on the TM in any way, but its not hard to imagine what market LastMinuteLotto would be aimed at?
