CHICAGO - A federal judge presiding over a spam dispute rejected a marketing company's request to suspend the domain name of an anti-spam group that ignored an $11.7 million judgment against it.

U.S. District Court Judge Charles P. Kocoras denied a proposed motion from e360 Insight, which sued the Spamhaus Project over its "black list" of spammers. Wheeling, Ill.-based e360 Insight contends it is improperly on the list because it is a direct marketer that does not send unsolicited e-mail.

It didn't need to be defended, because the simple fact is that the US has no jurisdiction over a UK based company... If some company in the UK tried to sue them for the same reason, I'm sure they'd do everything they could to defend it.

Theres no freedom of speech when it comes to making claims and potentially damaging a company if those claims are not true, then it's just defamation. I'm not sure of Spamhaus' methods for determining if a domain is a spammer, but out of all the domains they block, I'm sure it's safe to assume that there are a few who are wrongly accused. So if a company could prove that they have never spammed, then they would have a strong case.
