Iron Man wins UDRP case

When he is not saving the world from evil in his armour clad flying suit or investigating crimes with his sidekick Watson, Robert Downey Jr is actively protecting his intellectual property online via mechanisms to dispute domain name registrations.
The renowned actor from films such as A Scanner Darkly and Tropic Thunder recently took on a dispute over a new .actor domain name which infringed on his trademark. The domain name robertdowneyjr.actor had been registered to a Shashank Agarwal from India who claimed in his defence that he is publicly known as ‘Robert Downey Jr’ as his screen name for his career in the Indian cinema which is more popularly known as Bollywood. Mr Agarwal then also advised that he had “no knowledge of the American Hollywood actor Mr Robert Downey Junior prior to the fact of this arbitration, belonging to a third world country and having a native language other than English.”

Later on in the process the attorney for Mr Downey Jr advised that the complainant had emailed them stating that “I purchase this domain name few days back as I am the big fan of Mr. Robert Downey Jr.”

The panel inevitably found the case in Mr Downey Jr’s favour due to the reputation and international fame of the complainant, the domain only being registered on the 31st August and finally the domain being parked on GoDaddy’s parking pages and it being used for monetisation. The domain name was ultimately transferred over to Mr Downey Jr.
