Having read with horror the small print of domain registrations with Enom that Equity has so graciously given of his time to provide and to explain - two things emerge.
1. Enom need not give any reason at all with new regges during the first thirty day window to retract/withdraw from any body regging through Enom, be it .tv, .com or otherwise....as opposed to GoDaddy, which can withdraw but only with cause as outlined in their T&C.
2. enom singles out .TV exclusively and give themselves an additional window of oppurtunity of 30 days to withdraw the reg - with and without cause during the renewal period.
Point Two is a huge legal nightmare with massive implications to anyone with a .TV website - premium or otherwise. Fleaakings' nightmare has hilited to all of us this nightmare and whether or not Enom will or wont, good publicity, bad publicity etc etc , take away a name during the renewal period - no self respecting business would invest in a business where the very foundations of its model are under threat from the whim of the registrar.
I myself am taking the ramifications of all this very seriously indeed, as I hope all others will - who are considering investing in the development of one of their names.
A seperate and additional issue remains for those such as myself who have invested in the domain name itself - the premium speculator......the ramifications here are the same - I see nothing in the T&C that offer premiu holders any additional protection whatsoever to those with a standard reg fee.....when renewals come around - they have a 30 day window to arbitrarily remove the name.....how this impact plays out is being played out as we speak.
One more point, anyone buying a .Tv off someone else, should now, IMO, hold back from paying any monies to that person for the first thirty days of transfer ownership - in case Enom decides to execute its grotesque with or without cause clause...thus meaning that if you have paid the original owner for the name, not only will you suffer pain from not keeping the name, you are also now left on your own to getting your money back from the original owner
Maybe I have not read all of the repercusssions right, I am happy for Equity or anyone else to point out to me if I have gone wrong in my analysis.....
