I am checking uspto.gov to see if a few .mobis I have are registered as TMs. On some of the names their seems to be multiple TM holders for the exact same name. How do I know if any of the current registered TMs have a lock on the name? Also how is it possible for two or more companies to have the exact same names trademarked? Thanks

my understanding is if you have a GENERIC term and a defined business plan that absolutely does not infringe on an existing tm of the same term, you're ok (eg- if you wanted to tm Apple, a tire company). if it is a non-generic, eg. microsoft, google, itunes, etc. you have no chance.

more than 1 person can tm a term, usually a generic. it would often be the image they have tm'ed to
if they are in differen't classes/areas too.
for example 'peaches'
this is made up, but:
peaches - tm for skincare cream
peaches - tm for fashion store

they don't affect each other so tm 's would prob. be granted for each. it is a generic term so no one person can claim

however if you owned peaches.mobi, if you had their products on your parking pages ot tried to set up a company selling similar products you would get a lawsuit.
cheers
