Registering a business name is done on the local level. It varies by county, and is normally done at a county or city office. What county in New York do you live? This information may be available on your county's website.

In my area, you go to the county clerk's office and file for a "fictitious busines name". There is a fee and its required to publish the new name in the newspaper. At the time of filing, the clerk provides a copy of the name filing that can be used to open a new bank account in that name. Also check with your city to see if a business license is required.

You may also want a registered trademark. A registered trademark covers your use of that term in the US for a particular industry purpose. If you want a registered trademark, that is $335 to file. It can be done online at http://www.uspto.gov/teas/index.html

Ask for information at the local level also for the filing of a "DBA" ("Doing Business As ... "). This will be filed on the U.S. Schedule C Tax Form at the end of the year (as part of your regular 1040, not a corporate filing). :gl:

Down the road, for both tax and/or liability purposes you may wish to consider an "LLC" ("Limited Liability Corporation"), or some type of other incorporation or even partnership depending on the specifics, needs, and after consulting with both an attorney and tax advisor, IMHO.
Filing "DBA's" and getting started with a checking account though is easy, as mentioned above. The tax filing is easy at this level, as well ... though you'll be subject to self-employment taxes.

All the best!

Search for your state Secretary of State office and look for business startup information. most states you can file a business name either as a corportation of various types, Limited Liability Company (LLC), partnership, or Doing Business As (DBA) name for a proprietorship. Most states charge less than $500 and it protects you in that state. To protect your name nationwide, you need to file a trademark with the US Patent and Trademark office listed in another reply.
