How soon will ABC sue Google over TM

My PREDICTION is simple

Google will be sued very soon by ABC over TM violations

Think about it, a public company rips off the TM of another famous Public Company

ABC is ABC and it sure is not Google

WAKE UP ABC time to sue the towlah running Google

My take on this is public

GOOGLE SUCKS

The latest use of ABC's TM is just a typical example of how the evil empire that is Google can do what it wants.

Only this time they stole from a major public company ABC

This is my public OPINION on it

I flat out call Google what it is

Huge media company

They got tons of lawyers

It's probably in their PTM dept now

ABC is a major USA TM

Google will never be able to use abc.xyz

It's like Google saying OK we're BBC.xyz now

It's a perk business members have

And the way I read the TOS here, biz members can get unlimited biz accounts

So have to ask Big E if each biz account gets that extra regular account too

You have a biz account so yeah you can get a 2nd regular account

Then ask Big E to make it a established member immediately

You're a VIP account and don't even know that a business member is allowed two accounts

The question is, if we get say 5 business accounts can we have a regular member for each biz account

I said yeah, you're a biz member and you can have a 2nd account too

It's obvious NP wants people using business accounts MORE MONEY for NP

as a perk they allow a 2nd regular account

So that mans one company or person can get 8 sales posts by being a business member

That's the value of the accounts

Being able to have 8 auctions or sales threads a day

So the question I have now is the 2nd member account for biz accounts good for every biz account

We see value in traffic here, NP is busy, we're not sure if it's auction listings or make offer or whatever, but it seems they have nice flow of domain traffic so it's probably a good place to list stuff you want to sell to investors or dump to newbs

Most people posting in the forums aren't 'investors' they're just people spewing it's ok to spam email end users and they think that's being a domain broker.

There are well over 50 trademarks on the term ABC. Which one are you referring to that is a holding company.

The Famous ones that I know of are:
ABC NEWS
ABC FAMILY
ABC MOUSE

None of those would fit the guidelines for cybersquatting.
Under the ACPA, a trademark owner may bring a cause of action against a domain name registrant who

• Has a bad faith intent to profit from the mark
• Registers, traffics in, or uses a domain name that is
  • Identical or confusingly similar to a distinctive mark
  • Identical or confusingly similar to or dilutive of a famous mark
  • Is a trademark protected by 18 U.S.C. § 706 (marks involving the Red Cross) or 36 U.S.C. § 220506 (marks related to the “Olympics”)

I doubt it was registered in bad faith:
1) n. intentional dishonest act by not fulfilling legal or contractual obligations, misleading another...

I do not think that Google is intending to mislead anyone into thinking that they are ABC news or ABC mouse, when they registered ABC for their holding company name.
I do not think that Google is intending to hold onto the name in hopes to capture some of the traffic flow to any other those sites or to turn a profit from its HOLDING COMPANY site.
I do not think that Google Holding Company is confusing in anyway with a News origination, TV channel, or a children's learning aid.

I say that you claim that Google is Cybersquatting, should be rethought or at least learn what it is to actually cybersquat.
Remember, that are tens, hundreds, or even thousands of trademarks using similar names but are different business.

You can have a trademark name "Mom and Pops" (a example) be registered by several entities.
Mom and Pops burgers
Mom and Pops computers
Mom and Pops grocery store
Mom and Pops junk yard
Mom and Pops furniture store

All of these can have the same trademark name "Mom and Pops" and each of them can have their own domain name "Mom and Pops" in different extensions and not be cybersquatting.

Just my thoughts.

Is Google a major USA public company?

YES

As soon as a judge in a US Federal court sees this he will advise Google to turn over the name and try to offer something to them as damages, a judge won't even waste the courts time with a jury, it's pure legal decision, another public company cannot trade on another public companies TM.

If you're a Brit, do you think Google can call themselves BBC.xyz?

If you're French, do you think Google can call themselves AFP.xyz?

Do you think Associated Press would let Google claim to be AP.xyz?
