Host co. placing pop up porn ads on my site

I have a web site hosted on a free server. In fact they are called freeservers.com. Recently some key words on my pages were highlighted when I had not coded a link for those words.
The links initated a pop up ad with pornographic language supperted by a direct link to pornographic sites.
I checked my code and there are no links there and when the site page opens there is a delay to the words becoming highlighted.

The sites ISP refusses to address the issue with me unless I UPGRADE acount? Is this ethical and legal. Any advise please.

Its a free account, they have to be paid somehow, use Geocities, the same thing will happen to you ;)

TOS forbids my use no mention of them

I've used the host for a few years and have other sites hosted with them. Only this one effected and none of the paid accounts have ever had this problem. None of my sites have ever had this prob. All have been hosted a same Host provider.

You might want to check your PC for spyware as well. Never hurts to give it a cleaning once in a while

it can't be spyware if his ISP wants him to upgrade. I'd upgrade/upgrade elsewhere :)

Spyware was the first word that came to my mind, but as affordahost notes, they already aknowledge their involvement when they ask for an upgrade in order to stop the ads. I'd switch (free) provider ASAP.

Well I didn't know that they agreed to put porn on your site. What happens if a 12 yr old kid has a site through them... would be shaky grounds legal wise. Unwanted porn ads on your site is not good. Best of luck

Thank you all for your input. I do have a childs site hoted with them. I ussed your advice and pointed out that the TOS does not address this issue to any degree of consideration of children having access and being welcomed to a site/company that supports and provide adult ads.In fact the terminology in the TOS clearly states they (freeservers.com) have the right to freesite ad revenues. The TOS also clearly states "they" alone have that right. Thus they assume the liabilities generated. I think they found some weight in the observation and have made several attemps to assure me this will not happen again.

I am considering a seperation of relations with them, however I am extending the oppertunity for them to make good on the promisses made to me. I will update this thread as warrented.
