I received a offer on this one a few days ago.. I really had no intention on selling, but for the right price I'd sell in a heartbeat.

I'd like to know what you think the name is worth to a end user, If you knew it was going to be developed into a online store, what would your price be?

I have not counter offered as of yet.

I would take the offer if above xxx imo, unless you have better plans for it, just sell it

It all depends on what their initial offer is.

If it's somewhere in the low $xxx, counter with $1,xxx.

I wouldn't get to greedy on the negotiation with this one.

The end-users I see dont seem like they would have alot of financial freedom.

Bottom line is, if the price is right in your eyes then let her go.

If you have bigger and better plans then what they offer, then keep her.

Somewhere yesterday or so, on NP or DNF, there was a domainer looking for domains with 'reef' in it, so it may be them or someone trying to get to sell to them. Just a thought.

Low x,xxx to mid x,xxx

I think in that range is pretty probable a sale and at the same time is a good amount.

More is possisble as well in the case someone like it very much, but less probable

Seems I have some work to do in getting it up to $5K.

I think, you should negotiate wisely and sell it as the buyer is already paying you $1,500, he can go for more as well.

I'd be very happy with $1.5k, but clearly this is their lowball, so they'd probably be willing to pay up to $3-5k.

Be sure to acknowledge the active TM on any sales contract in case this the buyer is not the holder and registrant of the clear trademark on HiddenReefโ„ข. Wouldn't want to knowingly sell a TM domain would we. That would be wrong and very unethical.

Perhaps this forum should not even let you discuss such names because it increases that negative perception of domainers and all that.
Even if the reg predates the official TM granted date on sale everything comes back into play.

Personally I like to think its ok to discuss the name but there are those who have been very vocal about namepros allowing sale etc. of obvious TM domains. I think the clear registration of Hidden Reefโ„ข would make it known. A very quick search would show Hidden Reefโ„ข as registered.

You might, as an example, invoke the wrath of this user:

...the FACT that offering to sell domain names that infringe on a known Trademark is not only WRONG but ILLEGAL, Trying to justify bad behavior will never change that FACT.

"hidden reef" is a generic phrase.. no one on this earth can trademark it for every imaginable use..
if you own hiddenreef.com and not infringing by parking or whatever is applicable it's yours and you can sell it, appraise it, keep it or use it for your family album..

The issue is not always what you knowingly sell but what the buyer is knowingly buying. The seller may have responsibility in what the buyer knows depending on the sales agreement. That's where your/mine/and RGs liability begins and ends.

That should answer the question.

I'd be very happy with $1.5k, but clearly this is their lowball.

In my experience, this is not a low-ball offer and likely the top price they're willing to pay. Generally, these guys make an offer and move to another name. There is chance that the buyer will go higher, but it's less than 50/50. I'd recommended accepting the offer unless you are willing to risk a great price for this domain. Good luck.

i see now, thanks for making it clear to me.. so selling TM may be OK but a buyer should be notified of any possible TMs? i'm selling 1-word domain and as many English nouns it has multiple trademarks not only in the US - should i send the buyer a full list of those TMs before even discussing a price? that would possibly ruin the deal (because the buyer can be unaware of TM laws or because they have not checked beforehand) yet the name is a generic word and they probably were not going to violate anything by using it appropriately.. what would you do if the name is sold thru Sedo fixed price listing for example where you dont even have a chance to contact a buyer prior to sale is closed?

If you really weren't looking sell, why not counter around $7000 or more? It's a popular name, but the business using it tend not to be huge. If $1500 is their top price, as Microguy says, and it's not good enough for you, you're likely to loose them whatever the counter-offer. If it's an opening offer, then there's plenty of room to negotiate.
