if say you get dell.com

what is the big matter about it? its not my mistake, i got the chance to get it and i did. if the company really needs it, let it buy it from me.


is there a legal document about this?

That violates TM law, and the company would not just buy it from you as you suggest, they would send a C & D letter, saying that if you don't hand the domain over they are going to take you to court. In the case you mentioned unless you had some great reason to own dell.com, and it was not related to computers, then you would definitely lose the lawsuit, and even if you had a good reason, it is still possible you could lose depending on when the TM was filed.

Welcome to the forum..

Please, usse the search box and lookup "trademark" and "TM" and spend about a wek reading all the posts. Almost all circumstances are covered and will answer just about any questions you may have.

Whats does?
Its not illegal to own a domain. Dell can stand for a number of things, its what you do with it that matters!

Dell is a registered trademark, therefore making it a TM infraction. As DNQuest suggested take some time searching for TM and tradmark here at NP as there is a lot of interesting posts and threads in which you can learn a lot from.

CBA is a registered trademark as well, but cba.com is not owned by the Commonwealth Bank of Australia, neither is CBA.net or CBA.org.

I recommend you do as DNQuest suggested and read up on it, learn something about it first.

There are lots of legal documents about this and that's the big deal. You need a better scenario than what you have given in order to consider the problem. Usage does matter and so does frame of mind when you acquire a domain. If the intention is to get a company to buy it from you...you just broke TM laws...basically that's extortion.

As suggested...read a few pages here.

Exactly, thats what Ive been trying to say.
Its not illegal to own a trademarked domain per se.

So if he took a dell name and made it a cheese site....then he would be OK...but that's like a 1 in 10,000 that do that. Most want to exploit a TM.
