Should not being able to honor a BIN listing attract penalty and bans?

Hello guys

Last week I had someone hitting 3 of my BIN listings. I found I did not have 1 domain with me anymore and politely wrote a mail apologizing for the same. I gave transfer code for the other two domains and apologized to the buyer as well as GD for not being able to sell the 3rd one.

This was the reply received from GD:

Dear ***,

Your auction account has been suspended due to non delivery of ***. You will need to pay the admin fee to have your account reactivated. I have placed the fee in your cart. Please notify us by responding to this email when you have processed the fee. We will reactivate your auction membership at that time.

Regards,

It was a very small sum, but I asked whether this is really required for not doing it deliberately. I received a reply saying first offense is 10$, second offense is 50$ and third offense is permanent ban.

Well, I won't blame them, after all it is my mistake. But isn't this something that needs to change considering human beings are forgetful in nature? I have made similar errors before in NJ, Sedo but they never outcast you. Trust me, I am right 99% of the time. But I am not a robot, I do miss sometimes. :-/

Sedo does a whois check periodically on your listings and they remove the listings when it does not match with yours. Shouldn't GoDaddy implement something like this as well? Shouldn't the matter end when they refund the buyer? Shouldn't they work on this policy?

I am no one to advise them but what do you guys think?:?: For most of us domaining is not a full time job. We might be doing these things between jobs and could get distracted. Or the 2fa code must have failed to come when we tried to login.

Even if I understand that we are humans and make mistakes I am also aware that domaining is a business and every business needs to be professionally conducted.

I am not saying you are not professional, what I am saying is that "the law does not condone ignorance, forgetfulness or distraction" so to avoid situations like this which are more common with intangible items ( no one would forget they didn't sell a car... ) I would suggest to list names with make offer especially if you have a very large portfolio.

I agree though that GD could and should automatically remove domains that do not belong to that account anymore. It shouldn't be hard, especially if they are with GD itself.

I know this is not exactly the same as your situation, but having purchased a few domain names which were not available - is not a good experience. I am not saying GD is right, maybe they should check their inventory better, and excuse a first time offenders, however

This happened to me a lot while I was on the buyer's side of things, and it's never fun. This happened on Sedo, about 15 - 20 times already, maybe more - I lost count. Basically the same scenario, I purchased a domain using buy it now option, pay for it, using my credit card, then sedo takes forever to transfer the domain and finally I ask what is going on and they say, well, they are trying but the seller doesn't answer. It takes another 2 weeks and then the sale is finally closed. And then transfer the money back to my credit card in another 4-5 days.

We are talking about $500-$1200 transactions, and a few at a time. Now, what end up happening is - you end up having to pay credit cards, for the domain name you haven't actually received, but you wnat to pay off the cards so you dont' pay %. Then you end up having to track all those records for your tax purposes, since you dont' want to pay taxes on the amounts sedo "pays" you back. Finally, it does happen sometimes, that you purchase them in one year, and sedo returns you your money in the next year. Basically - it is not ideal when it comes to finances, so we all have to be careful about selling this way.

I understand it is difficult to track, if you have a lot of domains - you are right we are not robots, so I also list them as make an offer, unless I know for sure I have the names. (I own over 3000 domain names all together)

i guess there is a huge difference with my examples, where the sellers never actually contacted the sedo and your example, where you said right away - you are sorry, and therefore - the buyer never had to pay the money. In this case - i think charging fee is not right, specially the first time.

Perfectly right imo.. I don't really care if the seller has too many domains to be able to manage them.

Chaos! Here I would say SEDO is at mistake for holding your money or for an answer from the buyer for more than 5 days. No answer from the buyer in some days, they should automatically return the funds.

It was first time offense. Buyer has paid and GD takes 5 or more days to verify the payment. That's when you know the domain has been sold. Once verification happened, I told them and transferred 2/3 domains. They didn't appreciate my apology, directly took off my auction access, put 10 dollars on checkout.

yeah, the problem is it happened already 10-15 times in a row. I was buying 4N.coms and 5N.coms at the time. It's not only they are holding the funds, but they effectively not allowing me to use those funds to purchase some other domain names - and therefore I miss out on the opportunity. As we all know - in this business opportunities come around fast and furious. Those 4Ns went up 100 X by now, and 5Ns are not that far behind. <>

If you cant remember to remove sales listing of domains you sold, you need to keep a reference procedure list. Because if your'e going to forget one thing you will probably forget something else too.

Nothing wrong with being a part time domainer, but you need a 'full time domainer' management style at critical times.

My understanding from a @Joe Styler interview is that GDs end game is to make GD registrar and GD auctions and Afternic one seamless experience. This will take a lot of time I think but I believe they have started coordinate GD reg with GD auctions in some ways. For example I have noticed that:
  1. My premium listings are automatically listed as 90 day BINs on the auction site.
  2. Correspondingly if I try to edit a GD auction BIN price I am transferred to GD Premium Listings to make the update in price there.
  3. I've also noticed that when I push a domain to my buyer's GD acct that the Premium and Afternic listings are auto cancelled. It would seem that soon GD will cancel any auctions for names that are transferred to new owners.
So I think eventually this issue will be eliminated but I'm hoping Joe Styler will stop by and clarify for us.

Yes that is the idea. We obviously can't control sales at other companies we don't know about but all in all we have plans this year to help continue to remove friction in the marketplace. Doing this by making it easier for you to list your domains in one place and manage them in one place but still getting maximum exposure for them on our sales network as well as some payment process and transfer of ownership improvements which will help eliminate some more of this friction and make it easier for you to manage and sell your domains.

I hear you johname. I am looking at a situation where you still miss things out after doing all that.
