I am not a lawyer so I cannot talk much about trademark.

But you can check other extensions, and you will see they are not always owned by Google. Because "gmail" is such a generic term -- the "G" could stand for Google, yes, but it could also stand for Green, Global, Great, etc. All of which can be used to brand gmail.cx as green mail, global mail, ...

cx is the country code for Christmas Island.
