thats strange that domainers like you do not fight with that, you do not have any own value, with domainers like you the domaining business will collapse

There is an underground or black market in most industries operating just outside the law, and this is what cybersquatting is to domaining. The black side. If the domaining industry does not stamp out cybersquatting itself, then someone else will step in and do it. That is what will be the end of this industry IMO.

ok. But you have to see the difference of cybersquatting and not cybersquatting. I already explained it before. For example the domain marlboro.eu is cybersquatting. The domain cigarettes.com is not cybersquatting.

So you have registered galactic-suite and plan to build a site about space accomodation when there is a business who have already done that. They have first use and your name is not just confusingly similar, its an exact copy.
They will have no problem proving that you registered the name in bad faith to steal THEIR traffic.
That, my friend, is cybersquatting at its finest. And illegal. IMHO.

If you cant see that this is blatant cybersquatting then your in the wrong business. this is a perfect example of cybersquatting. its so blatant that stevie wonder can see it.

example: somebody founded a company called "cigarettes" in chile. In your opinion the owner of the domain cigarettes.net makes cybersquatting

No value due to tm issues.

Do a lot more reading on the forums paying attention to the legal threads, before you register any more domains. There you will find information about cybersquatting.

Again.

If someone founded a company in chile and names it Cigarettes they would not be able to TM the name. BUT if they were the first person to use it THEN no one else can use it OR reg it as its there business and TM and intielectual property.

The hotel is called GALACTIC SUITES. It belongs to them . they dont own Space Hotels , Galactic Rooms etc. THIS IS THERE NAME. No one else can use the wording Galactic Suites for a hotel anymore as much as no one can use Best Buy for any stores any more. Using your logic it would be ok to reg Best-Buy.com. which is ofcourse false. you cant legally do that. it would be cybersquatting and TM Infringment.

Again if you think that there is even a chance that Galactic-Suites is not cybersquating then you really need to have a read of the legal section here. When the Hotel opens and by chance they find out you regged this name you are risking a world of financial hurt.

example: somebody founded a company called "cigarettes" in chile. In your opinion the owner of the domain cigarettes.net makes cybersquatting

WOW, you know how to pick 'em.

Galactic Suite is a Barcelona based company that plans to have a space hotel operating in orbit by 2012. Galactic suite are charging 4.4 million dollars per client for a 3 night stay in their space suites. They already have 43 reservations and 200 more interested parties.

The project has received an anonymous grant of $3 billion dollars.

It took me only a few seconds to find the above information. Let's see how long it takes them to find you.

This isn't just about cybersquatting, it's about openly exposing yourself to a potential lawsuit. You do realise they don't have to go to the UDRP?

Sorry but this domain is a liability, not an asset.

Mike

they could trademark the name in spain but they could not trademark it in USA, they were not the first person who used this two words, because galactic suites i something like "hotels near the lake" and this two words are used since about 50 yaers.
so how can you trademark a word like this in an englishspekaing country ? You can NOT.
You can trademark it in spain because in spanish it means nothing.

Best buy is a similar situation, everybody can use best buy in their domains, why not. it is a good marketing word. tell me why bestbuy.net bestbuy.org or best-buy.info doesnt belong to bestbuy ?

because in norwegish it means nothing, so they trademarked it only in norway

IMO this one is at least in the grey zone.
There may be a TM issue.
Check google: Galactic Suite
this is the first result: galactic suite

The domain name is one thing, usage is another.
If you don't have a good faith usage for the domain, then your ownership can always be challenged. Personally I would not be surprised to see this domain challenged one day. It all boils down to usage, your intentions, whether you had knowledge of any TM etc.

I did not find a US TM at USPTO but there is a EU trademark.
They might now win outright but they can cause hassle. There is a sword of Damocles that clearly affects the potential resale value.
