That is not a problem if you have other revenues such as advertisement and affiliate sales. According to marketing experts the two words that most attact people are NEW and FREE so it would not be the first site that offers free content to gain traffic and sell other things. It is true that there is not such a thing as free lunch but in the site development a free content is more to showcase other things the site can offer. The real problem of this domain is the name itself, it is not freegames.com it is tied to a unique console and I think Nintendo of America has their own channels of distribution for onliine content and giving away TM content unless you get some kind of license will end soon or later in a lawsuit. I think OP should drop it, learn of the experience and move forward.
