Good name, but I'd be concerned about copyright issues. Fox is a powerful media enterprise...even if the site was cartoons featuring foxes. IMHO

I agree with gary-glen...one of the first rules of domaining is not to register obvious trademarks...no reason to risk a major headache from a lawsuit if they want to play hardball with you.

To be honest when i first register the domain i didn't even remember fox enterprise media i just register because it had high search results, because its brandable and has keywords, also there are lots of cartoons with foxes, i was thinking in developing to anime website like animefox.co/ (this website is not the best example but there was one much better with fox in it but cant remember) that only shows japonese anime like naruto, dragon ball, one piece etc.. and also shows manga, or develop it to a a image/vector/jpg/icon website.

Searched the usa trademarks for fox cartoons there wasn't any except for fox toons but it was long dead, so i thought it was a killer domain but never remembered of fox media until recently.

I truly see value on this domain and i never bought this domain with intention on steeling traffic or infringing in fox media trademarks. There are lots of cartoons that are of foxes some even have the title with fox, also fox cartoons can be images, vector drawings etc. and if i develop it to a video anime website i wouldn't even feature anime that shows on fox channel only japonese anime.

I feel like if fox could sue me for trademark infringement this would be really unfair how can some one own a keyword like fox cartoons its the same has owning the keyword god of war how can some one own a keyword that is involved in the human history and culture and of a god in my eyes this type of keywords should be public usage no one should be able to own it.

I know that there can be multiple trademarks with the same keyword has long its in different sectores/industries but how can some trademarks sue other businesses that are in different sectores just because they dont have a trademark and they used two keywords that basically form a new keyword.

All this said i know fox media his a powerful enterprise and dont want trouble with them but at the same time i feel like i didnt really infringe in any trademark and that fox hisn't really interested because if they where they would register the domain and trademark for fox cartoons like they did in the past with fox kids that was basically the channel they reproduced cartoons/anime.

I would love feedback from experience domainer's with good knowledge on this areas.

Names like this are not worth the risk, if the name was really good then maybe it was worth the risk of UDRP and fighting it, but i cant see this name being worth it

If you wanted to go down this path, why not go with something like "Dog Cartoons"...the name is not limited to Foxes then

Put it in the legal section if you want more info on trademarks.

Since you already have the domain, I'd say run with it. If, and maybe if, Fox comes after you, they'll just send a Cease and Desist order to the Whois person of record. Worst case scenario is they could confiscate the domain. There would be no need for further litigation since you didn't harm their brand, capitalize on their name, nor deprive them of any earnings. Therefore, proving any damages would be near impossible.

It's just another case of buyer beware when registering a domain, especially if you have a lot of money vested into it...you could lose it! Trademark laws are completely insane these days. Even due diligence sometimes isn't even enough.

@gary-glen you seem educated in the trademark/legal area, if i dont develop this domain into a website and decide to sell the domain in a domain marketplace like sedo for example, would this infringe in "capitalize on their name or deprive them of any earnings" and if fox media does decide to go after me will they be able to sue me just for selling the domain?

Basically my question is can i get sue by fox for selling this domain in a marketplace?

"It's just another case of buyer beware when registering a domain, especially if you have a lot of money vested into it...you could lose it!" its true i actually bought this domain with another 40 domains so i didn't search for trademark's for them all and i found out 3 domains may infringe in trademarks so now i have to delete them this just shows you can never be lazy on this matter always research the domains, but in the case of foxcartoons.com i did research if there was any trademark for the keyword fox cartoons at https://www.uspto.gov/trademark but it was after i bought it. Also the only result that showed was for fox toons and it was long dead and there was no trademark for fox cartoons.

Who said they have to prove it? They can still sue, even if they would eventually lose the suit...and the cost of dealing with a lawsuit from a major company for a regular individual would be crippling.

Yes, as soon as you benefit financially from the name, you are infringing on their trademark, selling it is making money off it...its really that simple

Just get rid of the name, its really not worth much so its not worth the risk.

yes i understand the this domain isnt worth the trouble.

@gilescoley i register this domain at dotster and they dont allow to cancel/delete any domain i already contacted dotster support and they say that they cant cancel domains. what should i do just wait for the domain to expire??

Yes, you cant just wait, just don't park the domain so it has ads all over it

What everyone above has said could be true. I doubt it would go to those extremes, but you never know. Just to be on the safe side, I'd just let the domain drop. Unless, of course you get an extreme rush from gambling. :laugh:

It's worth using that tool that papeter suggested. I used it once for a domain I was sure wasn't trademarked, it proved me wrong and saved me from wasting $xxx.
