I just got a C & D registered letter for the second time. The timing is great since I just finished reading the Nov-Dec 2007 issue of Domainer's Magazine that had a couple of GREAT articles on this very topic.

In my case, the 5 parked domains are not making much and not worth much to sell, and some DO use the company's mark. So I am just giving them up.

But it's funny because they send this nasty letter and demand that I transfer the domains to them, yet they don't say how I should transfer the domains?

I have a few other domains that someone could want and that would be hard to defend, so I'm dropping them as soon as I can.

I just wish they could try being nice to start with. I know that wouldn't work with some domainers here, but I think a lot of us are willing to give in when a company does have a pretty good position, no?

I don't think it is a sign of weakness or something that puts the company at a disadvantage, so why not be nice at first? Ebay was pretty nice last year when they contacted me, and I really appreciated it. It would save a lot of legal fees that are wasted, in my opinion... :)

Evil C&D letters are often cost-efficient. In many cases the might-makes-right, scare-the-bejesus-out-of-you strategy works so well on the first try that many twitterpated recipients just automatically flush the domain toilet...which eliminates the need for a 2nd or 3rd letter oozing even more vile and vitriol.

Seriously though, I hear what you say and am seriously thinking about a distance learning LLM in IP from London Uni (not a lawyer but you dont have to be to do it). Sometimes lawyers and their legal qualifications are invaluable of course.

Personally, I think they are great! Well, as long as they are not defending squatters and infringers... :)

Usually, they don't know how. Unlock the names, send them the auth codes, and it's an outside chance they'd know what to do.
