So simply having Ecko.net is against a TM? I searched and could not find a registered TM for just the name.
I just got off the phone with a lady that works at the USPTO. It hilariously derailed into a conversation about whether or not I could legally put porn on it (I can). She checked her entire database and it doesn't appear that I am breaking any laws by owning this domain or trying to sell it.
The clothing brand is associated with both "Marc Ecko" and "Ecko Unltd" but not simply "Ecko" so I'm safe there. "Ecko" IP infringement only applies to the ventilation and metal fabrication industries so as long as I don't enter those markets or show any ill intent then I'm fine.
With that said, it's got to be worth something. This domain was owned by a Korean company for about 15 years and no one else has touched it. I'm sure many people have been salivating over it for many years.
Check it out I turned it into a porn site.
