I'm sure that Disney must really try to safeguard their trademarks. But, I sure see a lot of Disney-something names listed on the various sales sites, and in fact being sold for prices in the hundreds of dollars at tdnam.

What's really the story on this? I'm sure Disney doesn't care about the crappy names, but some of them are very good. Do you think they don't care, don't see them (hard to believe they would not monitor them daily with some service), or the owners of these domains are just saying sue me?

An email from Disney

After I registered a Disney-related domain that obviously contains their trademarked name, I thought that I made a mistake. I decided to ask the registrar to delete the domain, but before I was doing that, I sent an email to Disneyland resort and said that I would be willing to transfer the domain to them with no cost.

Their response was:

Dear ****,

Thank you for your e-mail to the DISNEYLAND(r) Resort.

We thank you for your consideration but do not currently need the
Domain **** ... (** I do not include the entire message here...)
----

So, I sent them an email again asking if I could use the domain. Their reply was:

----
Dear ****,

Thank you for your e-mail to the DISNEYLAND® Resort

Because you have purchased the rights to that domain, you are free to
put whatever content you wish on it.

(** I do not include the entire message here...)
---

My regret was... their reply was slow, and my decision to ask the registrar to delete the domain was too quick.

I think that Disney just went on a spending spree when they first set up shop on the Internet, they don't appear to be doing much spending on anything but their very special trademarks. Any company with any degree of sense should protect and uphold their EXACT trademarks when it comes to domain names.

You could re-register it - that letter is permission to use the name (reasonably). I think after that they would have a difficult time taking it from you.

An interesting point - I imagine they are thinking that your site would overall help advertise their products - much as the Grateful Dead encouraged concert taping.

I have a really good Disney name, but I'm not confident about the long term security of holding it. I'm guessing the best place to sell it is on tdnam.com, where the most unsophisticated buyers reside. It seems many do not understand tm issues, at least by their bidding up these types of names all the time.

Disneyland Resort, in court, would not be a reliable source of permission to legally use the domain. You talked to some minumum-wage customer service individual that would certainly loose their job at the very least, if the issue every came to light. IF Disney legal was aware, the C&D letter would have been short in coming.

If anyone is interested, I just listed I just listed DisneyHotel.info on a 7-day auction at tdnam, with a very low ($xx) reserve price.
