Digg??

Hey ,

I was thinking of registering a domain with DIGG word in it. I want to develop it as a forum.

I checked uspto website and DIGG has been registered as TM as we all know as news website where people vote for news.

But my forum would be in a very different field.

Would i face any legal issues?

Nothing's going to stop the trademark holder from trying to go after you. But
at least you can possibly defend your usage by proving such if it happens.

Unless you are a J.D. or have some lawyers to confirm with, I wouldn't recommend that you register the domain.

A forum is also web community, so it may not be a different field. Say if you open a garden equipment shop called Digg, that's a different field.

I don't think digg or Kevin Rose will mind if you start a forum. However, they might be concerned if you start a site like digg.com itself and use the trademark.

I was worried since forum can also be taken as a news sharing medium as digg is but in a different way.

If you see namepros too... you would like to read threads with recent posts and how threads position is decided is on the basis of the most recent posting. That can be taken as user voting.

So they can proove that forum is like their site Digg.com

There is already a forum called diggfans at diggfans.com
It's been around for awhile. Just to bring that out.

yeah absolutely but Digg is not going to go after diggfans since they have no harm from that.

I believe Kevin Rose doesnt like it when people sue people for stupid stuff like that, if you watch diggnation, so Im pretty sure it will be cool, if not why not just add Kevin on myspace and ask him if its cool?

If you really want the answer ...post the same question on "DIGG" (great site/concept). Kevin is great guy but he's not stupid. Plus he's recently recieved a considerable amount of venture funding. So there are more things for Kevin to protect these days. I would respect the unique personality he is and float this past him on DIGG or one of his other forums. Your right that he is a bit of an anti-establishmenter but he's also level headed and very very smart. He wont get taken advantage of.

TWIT (This Week In Tech) is another forum he, Kevin, participates in with Leo Laporte and Patric Norton, And some other notable "tech" personalities. (great show)

If yours was a respectable forum I would participate.

Just don't advertise that you're using it in relation to digg and you should be fairly fine.
