Hello,


I need some advice in these :

I've checked the licensed list for animes, and I found these :

Apparently, Gungrave is licensed in USA, but I'm from Malaysia. I also checked with the people incharge at local stores, they said, most of the animes ( 90% ) are not licensed in Malaysia, Singapore, Thailand , Philipine, Indonesia and most countries around here.

We have imported titles, but just few of them are available.

From what I've read on the Internet, licensed DVDs are divided into regions, and for that purpose, some DVD players are not compatible with other regions.

So I think it's legal to host downloads for animes that are not licensed here (in and around my country), as any chargers for licensed materials applies in that specific region.

What do you think?

It depends on whether the country of origin and the country where you are located are members of WIPO (http://www.wipo.int). If they are, then its intellectual property is still protected internationally.

If the country of origin is a member of WIPO, then there's an EXCELLENT chance that they will get your domain shut off since WIPO and ICANN are friendly to each other.

No way. Without a license you can't use it, sell it or offer it for download. That's all there is to it.

I forgot to say that these are not ripped from DVD's or CD's. It's a fan subbing which are not commercially available. It's different from the ones on the rack. Most of the fansubs are from US, they sub the raw directly from Japanese TV station. They said it's legal as long as it's not licensed in US. Check www.fansub.tv . So I would like to know, does Us licensed applies to the whole world?

In intellectual property rights, as long as the company/producer doesn't suffer any lost, and we didn't earn from their hardwork, it is still ok? Am I right?

It may not be a criminal offence to pirate DVDs for personal use in your country, but it is certainly a civil offence. All this stuff about it being legal because it isn't licensed some place is bunk. Just a pirates urban legend. Sometimes people will overlook this kind of infringement because it isn't causing them any losses. But there is absolutely no question. It is not legal.

Besides, even if it was legal in your country, most hosts say that you must abide by the laws of the United States.
