Can we register a domain with dead Trademark?

I have few names in my list that has dead trademarks.

i was wondering whether or not it's ok to register a domain with dead trademark?

its OK to register a name with a dead trademark.
its OK to register a name with a live trademark.

My only concern since name has a trademark on it whether dead or live should not create any legal complications.

live one is a concern, but I don't think dead one is.
