Hi all,

My father has owned this domain for over 20 years now and a few days ago Caesar's Entertainment has reached out asking to have the domain transferred to them while stating that we were infringing on trademark laws. This domain has never been used and was in no way ever purchased with the intention of infringing on Caesar's Entertainment's trademarks.

I am assuming that they want this domain because it would be valuable to them, they already own caesarslasvegas.com which redirects to their main website caesars.com. That being said I do not think that it would be fair for them to just take it without compensation to my father.

Can anyone suggest how much this domain could be worth and if possible any advice on how to proceed with this? References for great domain / trademark lawyers are also welcomed.

Thank you!

your running ads for caesars hotel. They will probably ask for the parking pennies you made as well.

Hello, no ads are being run. This is the standard page displayed by network solutions which replaces a “not found” page for domains not yet attached to active websites.

Regardless of weather you set up the parking page or not ,it leads to ads that when clicked on may or may not cause a sale that network solutions will be compensated on ,and if a sale does take place it prevented caesars of taking the whole deal.It seems like the domain was regged to profit off the back of the co.
Call the company and ask them to at least pay for the back registrations ,if they bring up a suit against you I think they would need 2k to start. So you can just ignore and they may offer you something.I would tell them you have no access to the account and are willing to do the leg work to transfer if they put you up for a few days, All this being said you don’t have a snowballs chance in hell if they try to take the domain

I think this not much good domain. If there is only one hands in Vegas to own it.

Showing ads for Harrah casino now.
I am sure caesars like that.
Putting that aside, ever get any offers?
What business would run on this name?
I wouldnt even reg it, own it, or renew for 20 years, as stated above only one end user. They have deep pockets and their lawyers know it
C’est la vie

If it wasn't your fathers intent to infringe, what intentions did he have when he purchased it?

You might be able to ask them for a small amount of money to make it not worth their while going through the channels of seizing it from you, or maybe ask them to comp a stay, but legally they have every right to get the domain from you.

Google cybersquatting.

Don't be stupid. Just give them the name. There are better battles to fight.

Trust me it might hurt but it will pain if legal proceedings are undertaken. Ask them to flick you a couple bucks for the inconvenience.

I wouldn’t ask for any compensation directly. All correspondence you have with them could be used against you. Either give them the domain no strings attached or consult an attorney if you’re interested in finding another option. In the meantime, don’t point the domain to any content.

After thinking about it I really don’t think they can come after you ,I’m sure there’s a lot of guys named Caesar that live in Las Vegas ,it’s pretty generic. My advice move it to another registra now like porkbun with free privacy and point the name servers to afternic.com and put a buy it now for 1400 bucks, ignore any other contact

By itself it's quite senseless domain(2 words).[/QUOTEPlease clarify ,I really don’t know if you agree or disagree ,all I know is that ,with a register like godaddy they may comply to freeze a domain from being managed pending investigation.A company like Epik, porkbun ,where theses companies are domain based owners ,may tell caesars to GFT till they get a court order. I’m sure that there are hundreds of guys with that name or even hundreds or thousands of babies that were named after that ,I own Elvistown dot com ,and know at least 3 guys personally names Elvis,I sold Brooklynjoes . Com to a guy in Arizona ,I say get the domain out of his name because sometimes a company or better yet its legal team may spend 10 times what something is worth to them just to substantiate their jobs,so they may try to hurt the individual beyond just raping them of their domain. But this gets me to wonder ,how come they wait till now, probably one of the marketing team had a 20 year old brainstorn CaesarsVegas which happens to be very good for a permanent ad campaign.
Again get the domain out of gd and move it to Epik or porkbun with free privacy at both I think. Good luck. B

I have a hard time believing that this domain would have been registered if not for the famous "Caesar's" in Las Vegas. If it was registered for generic reasons, can you explain what they were?

About the only potentially feasible defense is laches -

It basically means a party took an unreasonably long period of time to assert their legal claim.
Even then, I am not sure how effective that will be.

Harrah’s owns Caesar’s Entertainment (since 2005). It’s a little confusing because after Harrah’s bought Caesar’s it changed its name to Caesar’s (in 2010).

In any case unless you were named Caesar and had say a blog or website about Vegas you’re basically just squatting here.

Try to make something positive out of this - bottom line, they will win & they are in the "right" to get possession of the name (legally anyway).

I would respond with an apologetic note, explaining the "real" reason the name was purchased & it was not meant to infringe (etc.) Offer the name in good faith and request some compensation casio's are comfortable with - some vacation comps? maybe a suite, vips access, food, etc.. Casinos have a big comp budget and doesn't involve "legal" to approve.

No idea if it would work, but thought a positive spin/possible approach may be helpful?

Good Luck,
Brian

Could not disagree more as stated in my post they are caesarspalacelasvegas not caesars Vegas , I would do what I said to do get it out of godaddy and post it for sale with a different registra than your selling it at,with auto transfer,as far as the compassion of the 1200 bucks your dad spent to renew at netsol which was more than happy to renew but will comply with just an email if those mobsters contact them. As far a asking fo4 comps now we’re talking extortion and they can take your house too,if they offer then that’s different,if they reall6 want the domain they either pay your bin or go the legal route which will cost them thousands with no guarantee ,maybe your dad was going to start up a fan club who knows, just dont demand anything that’s what they want you to do
