-How does this work if say a domain is expiring tonight? - how do I get it?

If it is expired tonigh, you need to wait for about 70-83 days more to register this domain name. To get the best chance, you need to using the service from some companies right now as:
Luckyregister.com (first comes, first serves)
Pool.com (Auction)
Snapnames.com (Auction)

Which company is it registered with ?
Different drop companies work with different registrars - so for instance if the name is registered with network solutions or bulkregister ... you would have more chance of grabbing it with snapnames, for example.

Try going to snapnames and doing a search for the domain, if it comes up check the whois for register, if it is as the two stated above place a backorder with snapnames, if they get it and there are more than one person backordered it then you will have to bid for it.
