I found an available 4 char domain that is the name of a band with one of the letters replaced with a number. I did a TM search and none where found.. Should I stay away?

In trademark law there is a principle called "confusingly similar". It means that if the brand is called NIKE and someone will introduce N1KE, the TM holder can say that N1KE is "confusingly similar" to NIKE and will insist on termination of usage of N1KE. The same principle may work in similar domain names subject.

Should I stay away?

GW4R dot com is available, and for good reason. There's no value in that name. I'd stay away simply for that reason alone, never mind that there might be possible trademark issues.
