Available name that can't be registered

is it possible for a name to not be registered and only to appear registered?

i found a name that i like, was registered at name.com and has expired in september but is not available
whois.net still shows the old reg. data
who.is shows "no domain"

is it possible to be a glitch in "the matrix" and to actually be available?
and btw, what whois site do you recommend?
