"confusingly similar" - absolutely, 100% so if they're using it to generate revenue off Windows 7 related products. Using it for a legitimate purpose unrelated to Microsoft (like, house windows, or whatever) would probably make it very difficult for them to shaft you over it, but park it with a ton of Microsoft related keywords, I'd be more than happy to bet on the outcome of that.
